Description:
Emptying street bins placed along municipal roads in the Ursynów District m.st Warsaw in the years 2023-2024.

The subject of the contract are services consisting in emptying 805 street waste bins with a capacity of 40 liters each, set up along municipal roads in the Ursynów District m.st Warsaw. Photos of baskets can be found in Appendix No. 1 to the description of the subject of the order.

Street waste bins should be emptied 3 times a week, i.e. on Mondays, Wednesdays and Saturdays until 10:00.

A detailed description of the subject of the contract is specified in:

- Detailed description and technical standards of the subject of the contract - Annex 1 to the SWZ;

- the proposed provisions of the contract constituting Annex 5 to the SWZ;

- Price form constituting Annex 8 to SWZ;

Responsibilities under the social clause

In the proceedings in question, the contracting authority applies a social clause pursuant to Article 95(1) of the Public Procurement Law.

1) The subject of the contract are services consisting in emptying 805 street waste bins with a capacity of 40 liters each, set up along municipal roads in the Ursynów District m.st Warsaw. Photos of baskets can be found in Appendix No. 1 to the description of the subject of the order.

2) Obligations under the social clause

1. The contracting authority shall apply a social clause in the proceedings in question pursuant to Article 95(1) of the Public Procurement Law.

2. The Contractor undertakes that activities in the scope of performance of the service contract, throughout the entire period of performance of the subject of the contract, will be performed by persons employed under an employment contract within the meaning of the Labor Code by the Contractor or Subcontractor.

3. The condition referred to in paragraph 2 shall be fulfilled by employing new employees on the basis of an employment contract or by appointing already employed persons to perform the contract, performing work consisting in emptying street waste bins set up along municipal roads in the Ursynów District m.st Warsaw.

4. Detailed requirements for employment on the basis of an employment relationship, in the circumstances referred to in Article 95 of the Act, in particular the method of verifying the employment of persons under an employment contract, the Contracting Authority's rights to control the Contractor's compliance with the above-mentioned requirements and sanctions for non-compliance with them are specified in the draft provisions of the contract constituting Annex 5 to the SWZ.

3) SIMILAR ORDERS:

The contracting authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law with a total value of up to PLN 250,000.00 net, consisting in: emptying street baskets set up along municipal roads in the Ursynów District. The contract will be awarded provided that the Ordering Party has the necessary financial resources and will be implemented on the basis of the basic agreement.

4) SUBCONTRACTING

(a) The Contracting Authority shall not reserve the personal performance by the Contractor of key parts of the The Contractor may entrust execution of part of the contract to the subcontractor

(b) The Contractor is obliged to indicate in the offer the parts of the contract whose execution he intends to entrust to the subcontractors and provide the names of possible subcontractors if they are already known.

(c) Where the modification or resignation of a subcontractor relates to an entity whose resources the contractor relied on, under the rules laid down in Article 118 (1), in order to demonstrate that the conditions of participation in the proceedings are fulfilled, the contractor shall demonstrate to the contracting authority that another subcontractor proposed or the contractor independently satisfies them to a degree not less than the subcontractor whose resources the contractor relied upon during the procurement procedure. Article 122 of the Pzp Act shall apply accordingly.
