The subject of the proceedings is a comprehensive supply of electricity including the sale together with the provision of electricity distribution or transmission services and the collection of electricity generated in micro-installation, i.e. settlement of electricity introduced by the Ordering Party (renewable energy prosumer) to the DSO network, generated in a micro-installation together with the provision of a service of receiving and transmitting this electricity under the conditions specified in the RES Act, for the needs of SP ZOZ WSPR in Białystok. A detailed description of the contract, in particular the names and locations of the facilities, the expected consumption of electricity, types of tariffs, contractual capacity - is specified in Appendix No. 1 to the SWZ, Appendix No. 3 to the SWZ and the Essential Provisions of the Agreement constituting Appendix No. 8 of the SWZ.

1.The subject of the contract is a comprehensive supply of electricity including the sale together with the provision of energy distribution or transmission services and the collection of electricity generated in micro-steel, i.e. settlement of electricity introduced by the Ordering Party (renewable energy prosumer) to the DSO network, generated in a micro-installation together with the provision of a service of receiving and transmitting this electricity under the conditions specified in the RES Act for the needs of SP ZOZ WSPR in Białystok, for a period of 12 months to the consumption points specified in point 2 with the exception of point 2 of point 9), where the planned energy consumption will be in the period 05.2023 to 31.12.2023.

2.The energy shall be supplied to the following locations:

3.A detailed list of electricity consumption points is included in Annex 3 to the SWZ.

4. The total contractual power for the Ordering Party's facilities indicated in Annex 3 to the SWZ is 216 kW.

5.The estimated electricity consumption during the term of the contract shall be 483,000 kWh. The above data are indicative.

6. Determining the estimated energy consumption is used only to select the most advantageous offer and does not constitute an obligation on the part of the Ordering Party to purchase electricity in the given quantity. The Ordering Party reserves the right to reduce the quantities in question. The Contractor shall not bring any claims against the Ordering Party in this respect except for the claim for the already delivered subject of the contract. The settlement will take place according to the actual electricity consumption based on the current indications of measurement and settlement systems. The Ordering Party guarantees energy consumption at a minimum level of 50% in relation to the amounts given in Annex 7 to the SWZ. The Contractor will be responsible for monitoring the state of electricity consumption by the Ordering Party.

7.In the location at Pogodna 22 Street in Białystok, the Ordering Party has installed a photovoltaic installation with a capacity of 25 kW. The indicated estimated amount of energy that the Ordering Party intends to purchase does not include energy produced on its own.

8.Billing period for individual energy consumption points - 1 month.

9.The Ordering Party excludes the use of forecasted invoices.

10. The Ordering Party reserves the right to change consisting in excluding individual locations from the subject of the order in the event of cessation of their administration. The Ordering Party is obliged to inform the Contractor in writing or electronically about this fact at the latest within one month before the end of the administration of a given facility.

11.In the event of selecting as the most advantageous Contractor other than the one supplying electricity so far, it is the responsibility of the Contractor to complete all formalities and bear all costs related to the start of energy supplies in accordance with the deadline specified in the SWZ

12.Tariff Group: C 11, C 22 A.

13. The Contracting Authority awards a contract for a comprehensive service, within the meaning of Article 3 point 30 of the Energy Law (Journal of Laws of 2022.1385, as amended), carried out on the basis of a comprehensive agreement referred to in Article 5(3) of that Act.

14. The Ordering Party declares that it has a legal title to the facilities or has signed lease agreements entitling to use the facilities to which electricity is to be supplied under this contract.
