Description:
Provision of municipal waste collection and management of this waste from the owners of real estate on which residents live, created in 3 (three) Communes in the Silesian Voivodeship

1. The subject of the contract is: "Provision of municipal waste collection and management of this waste from the owners of real estate on which residents live, created in 3 (three) Communes in the Silesian Voivodeship", i.e.:

1) City and Municipality of Pilica

2) Municipality of Irządze

3) Municipality of Żarnowiec

2. Object range of the order:

The scope of the contract is the collection and management of the entire stream of municipal waste provided by the owners of real estate located in 3 (three) municipalities where residents live, in a way that ensures the achievement of appropriate levels: preparation for re-use and recycling, reduction of the mass of biodegradable municipal waste transferred to landfill and not exceeding the levels of landfilling as part of the entrusted task.

The description of the subject of the contract (OPZ) is contained in Annex 1 A to the SWZ.

1. The total area of the above-mentioned communes is 341.18 km2, the total number of inhabitants – 13 814 people, while the number of properties inhabited by the so-called collection points 4 342 single-family and 8 multi-apartment. Including the number of properties with difficult access - 124 (the list of properties with difficult access is attached as Annex 7 to SWZ).

2. The minimum amount of waste during the performance period shall be estimated at:

— Unsegregated (mixed) municipal waste - 4769,730 Mg,

— Selective municipal waste - 1506,327 Mg,

— furniture and other bulky waste - 324,475 Mg.

3. The scope of the contract shall include the collection and management of the entire stream of municipal waste provided by the owners of real estate located in 3 (three) municipalities where residents live, in a way that ensures the achievement of appropriate levels: preparation for re-use and recycling, reduction of the weight of biodegradable municipal waste transferred to landfill and not exceeding the levels of landfilling as part of the task entrusted.

4. The Contractor is obliged to handle waste in a manner consistent with the principles of waste management set out in the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2022, item 699, as amended), the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2022, item 1297, as amended), in accordance with the requirements of environmental protection and the Waste Management Plan for the Silesian Voivodeship for the years 2016-2022, adopted by Resolution No. V/37/7/2017 of the Silesian Voivodeship Assembly of 24 April 2017, in particular through:

a) transfer of unsegregated (mixed) municipal waste received directly to the municipal installation referred to in Article 35(6)(1) and (3) of the Waste Act of 14 December 2012 (i.e. Journal of Laws of 2022, item 699, as amended). Pursuant to Article 6d(4)(5) of the Act on Maintaining Cleanliness and Order in Municipalities, the Contractor is obliged to indicate in the offer installations, in particular municipal installations, to which it will transfer municipal waste collected from the owners of inhabited real estate;

b) transfer of separately collected municipal waste directly or through another waste collector to a waste recovery or disposal facility in accordance with the waste hierarchy referred to in Article 17 of the Waste Act of 14 December 2012 (i.e. Journal of Laws of 2022, item 699, as amended).

5. The subject of the contract shall be carried out in such a way as to achieve the appropriate levels: preparation for re-use and recycling, weight reduction of biodegradable municipal waste sent to landfill and not exceeding landfill levels.

6. The management of collected municipal waste shall comply with the waste hierarchy set out in Article 4(1) of the European Parliament and of the Council 2008/98/EC of 19 November 2008 on waste and repealing certain Directives (OJ L 2008.312.3, as amended).

7. As part of the contract with the Ordering Party, the Contractor shall equip the property free of charge with containers with the minimum capacity specified in the Regulations for maintaining cleanliness and order of each Ordering Party – Participant.
