1. The subject of the contract is the supply of LPG (propane-butane) to the SP ZOZ WSPR Petrol Station in Białystok, specified in detail in Annex 1 to SWZ – Detailed Description of the Subject of the Order.
2. The Contractor is obliged to successively deliver the goods at its own expense and risk to the Fuel Station SP ZOZ WSPR in Białystok at Pogodna 22 Street in Białystok, in the manner described in the attached model contract, constituting Annex 8 to THE SWZ. The model contract is an integral part of the SWZ and the provisions contained therein are treated as conditions for the award of the contract.
3. The quantities given in Annex 1 to SWZ - DESCRIPTION OF THE SUBJECT OF THE ORDER, i.e. PROPANE-BUTANE LPG GAS: 231 000 l - the basic order are estimated / forecast values, which during the term of the contract may be reduced depending on the current needs of the Ordering Party. During the term of the contract, the Ordering Party guarantees the order of a minimum of 140,000 l of LPG. 4. The Purchaser shall have the right of option.
The subject of the contract are successive deliveries:
• Propane-butane LPG CN: 2711 19 00, CN 2711 12, CN 2711 13, CN 2711 1400 – in the amount of 231 000 l – basic order. The Ordering Party has the right of option to increase the amount of fuel, but not more than by 30%. The largest possible scope of the order taking into account the right of option is up to 300,000 l of fuel. The Ordering Party reserves the right to use all or part of the contract covered by the right of option, and the Contractor declares that it will not make any claims for this reason. The quantities given in Annex 1 to SWZ - DESCRIPTION OF THE SUBJECT OF THE ORDER, i.e. PROPANE-BUTANE LPG GAS: 231 000 l - the basic order are estimated / forecast values, which during the term of the contract may be reduced depending on the current needs of the Ordering Party. During the term of the contract, the Ordering Party guarantees the order of a minimum of 140,000 l of LPG.
Deliveries will take place to the Sp ZOZ WSPR Petrol Station in Białystok in the period covered by the contract, on the dates and quantities indicated by the Ordering Party, but not longer than 48 hours from placing the order. Deliveries will be made in writing, by phone, e-mail or fax order of the Ordering Party.
The fuel offered to the contracting authority must meet the requirements set out in the Regulation of the Minister of Climate and Environment of 28 May 2021 on quality requirements for liquefied gas (LPG) (Journal of Laws 2021.1293). In addition, it should meet the quality requirements contained in the PN-EN 589 standard or equivalent.
The subject of the order must be in continuous sale, have appropriate certificates and attestations required by Polish law. The fuel offered to the Ordering Party must meet the standards and quality requirements for liquid fuels, in accordance with the Act of 25 August 2006 on the system of monitoring and controlling the quality of fuels (Journal of Laws 2022.1315, as amended).
