The subject of the contract is the care of low greenery and maintaining cleanliness in the road lanes of the municipal streets of the Ursynów District m.st. Warsaw, with a detailed description of the subject of the contract specified by:

- Description and technical standards of the subject of the contract - Annex 1 to the SWZ;

- the proposed provisions of the contract constituting Annex 5 to the SWZ;

- Price form constituting Annex 9 to SWZ;

Responsibilities under the social clause

1. In the proceedings in question, the Contracting Authority shall apply a social clause pursuant to Article 95(1) of the Public Procurement Law.

Details of point 7 of the SWZ

1) The subject of the contract is the care of low greenery and maintaining cleanliness in the road lanes of the municipal streets of the Ursynów District m.st. Warsaw, with a detailed description of the subject of the contract specified by:

Description and technical standards of performance of the subject of the contract - Annex No. 1 to the SWZ;

the proposed provisions of the Agreement constituting Annex 5 to the SWZ;

The price form constituting Annex 9 to the SWZ;

2) Obligations under the social clause

1. In the proceedings in question, the Contracting Authority shall apply a social clause pursuant to Article 95(1) of the Public Procurement Law.

2. The Contractor undertakes that activities in the scope of performance of the service contract, throughout the entire period of performance of the subject of the contract, will be performed by persons employed under an employment contract within the meaning of the Labor Code by the Contractor or Subcontractor.

3.The condition referred to in paragraph 2 will be met by employing new employees on the basis of an employment contract or appointing already employed persons to perform the contract, performing the activities indicated below during the performance of the contract, i.e.: work consisting in caring for shrubs, raking leaves, mowing lawns.

4.Detailed requirements for employment on the basis of an employment relationship, in the circumstances referred to in Article 95 of the Act, in particular the method of verifying the employment of persons under an employment contract, the Contracting Authority's rights to control the Contractor's compliance with the above-mentioned requirements and sanctions for non-compliance with them are specified in the draft provisions of the contract constituting Annex 5 to the SWZ.
