1. The object of the order is to develop a multi-variant and multi-industry concept for the construction of the Heat Route, together with the necessary technical infrastructure and to obtain a final decision on environmental conditions.

2. The proceedings are carried out by unlimited tender (Article 132 of the Act of 11 September 2019 - Public Procurement Law (Journal of Laws 2019, item 2019, item 2019, hereinafter referred to as the Pzp Act).

3. Proceedings are carried out by means of electronic communication using the purchasing platform.

4. The estimated value of the contract exceeds the amount specified in the provisions issued pursuant to Article 3 (3) of the Law Pzp, i.e. EUR 214,000.

5. The Contracting Authority shall, in accordance with Article 139 (1) of the Pzp Act, first examine and evaluate the tenders and then make the qualification of the Subject Contractor whose offer has been highest assessed in the absence of grounds for exclusion and fulfilment of the conditions of participation in proceedings.

2. A detailed description of the subject matter of the contract and the scope of the Contractor's responsibilities are set out in the Annexes to the SWZ, including, inter alia, the Projected Contract Provisions (PPU), which is part of the SZ (SZ), which is part of Annex No 10 to the SWZ (which is at the same time. an annex to the Contract Pattern).

3. The Contracting Authority notes that, in view of the technical absence of the possibility to indicate in the contents of this announcement all the information on the subject of the order (too small number of characters possible to enter in each box of the form), this announcement contains references to the contents of the Specification of the Terms of Order (known as SWZ) posted on the Ordering Party's website https://zim.krakow.pl, under: Public Procurement and https://zimkrakow.ezamawiajacy.pl where there is a set of necessary information in this item.

4. The Contractor shall, before the expiry of the deadline for the submission of tenders, contribute a defect of PLN 30,000 (in words: thirty thousand zlotys 00/100).

5. In accordance with the disposition of Article 95 of the Pzp Act does not require that the person/persons participating in the execution of the contract be employed/e by the Contractor or Subcontractor under an employment contract within the meaning of the provisions of the Act of 26 June 1974 — the Labor Code.

6. The Contracting Authority provides for the possibility of awarding the contracts referred to in Article 214 (1) (7) of the Law Pzp.

7. Term of execution of the contract (contract) - 25 months, taking into account the detailed deadlines set out in § 6 of the proposed provisions of the contract (part 1 of SWZ).

8. Before signing the contract, the Contractor whose offer has been considered the most advantageous shall be obliged to provide a security of due performance of the contract at the rate of 5% of the total price indicated in the tender.

Information obligation arising from EP and Council Regulation (EU) 2016/679 of 27.4.2016 on the protection of individuals in connection with the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) - is described in section XXII of the SWZ.
