The subject of the contract is to carry out the service of regular transport of persons and carry-on luggage within the framework of the public transport system organized by the Municipality of Działdowo from the date of conclusion of the contract (not earlier than from 01.01.2022) to 31.12.2024. was determined at 275 522.64 carriages +30%/-30% (plus/minus thirty percent), hereinafter referred to as carriages.

A detailed description of the procedure is set out in the Specification of the Terms of the Order, the Annexes to the SWZ and the template of the contract.

1. The subject of the contract is to carry out the service of regular carriage of persons and carry-on luggage within the framework of the public transport system organized by the Municipality of Działdowo from the date of conclusion of the contract (not earlier than from 01.01.2022) to 31.12.2024. the order was specified at 275 522.64 carriages +30%/-30% (plus/minus thirty percent), hereinafter referred to as carriages.

1) line no. 1: M. Skłodowskiej-Curie Street — Wł. Jagiełły — Gen. J. Haller Street — Norwida Street — Nidzicka Street — Leśna Street — Świerkowa Street — Olsztyńska Street — North Street,

2) line no. 2: M. Skłodowskiej-Curie Street — Pocztowa Street — Kościuszki Street — Wolności Street — Sportowa Street — Budowlana Street — Leśna Street — Leśna Street — Leśna Street — Strowlana Street — Konopnicka Street. Hallera — Martyrs' Street — Kościuszki Street — Pocztowa Street - M. Skłodowskiej-Curie Street,

3) line no. 3: M. Skłodowskiej-Curie Street — Wł. Jagiełły — Pocztowa Street — Plac 1 Maja — J. Kochanowski Street — Osiedleńcza Street — H. Sienkiewicza Street — Księżodworska Street — Duchy Dwór,

The Contracting Authority reserves the right to increase the number of courses during the duration of the max. contract to 30% of the planned carriage kilometres. The Contracting Authority also allows the possibility of reducing the number of courses during the course of the contract by 30% originally planned for carriage kilometres.

1. A detailed description of the subject matter of the contract is specified in the contract model and Chapter II of the Procurement Terms Specification (hereinafter referred to as SWZ or Specification) as annexes to the SWZ.

2. The Purchaser does not allow the submission of partial offers.

3. Pursuant to Article 95 (1) of the Act, the Contracting Authority requires employment under an employment contract by the Contractor and/or a subcontractor and/or a further subcontractor of all persons performing the activities referred to in paragraph 4, as defined in the Description of the subject of the contract. At the latest on the date of the start of the service, the Contractor shall be obliged to employ the persons performing the activities referred to in paragraph 4, hereinafter referred to as employees, on the basis of an employment contract under the rigour of withdrawal from the contract for reasons on the Contractor's side.

4. Type of activities (necessary for the performance of the contract) for which the Contracting Authority requires employment under the contract of employment by the Contractor or subcontractor of persons executing during the execution of the contract:

- driving vehicles (bus driver).

the implementation of which contains the features of the employment relationship set out in Article 22 (1) of the Act of 26 June 1974 — Labor Code.

5. The Contracting Authority shall require that the Contractor submit a declaration that the persons addressed for the execution of the contract referred to in paragraph 3 are employed on an employment contract. The declaration should be submitted at the latest within 7 days from the date of signing the contract and shall contain at least the following data: the name of the employed employee, the date of conclusion of the contract, the type of employment contract entered into, the period of employment, the position and the scope of the employee's duties, for each person referred to the execution of the order. The Contracting Authority may request copies of employment contracts and/or other documents referred to in Article 438 (2) of the Act at any stage of the execution of the contract, from which it will be unequivocally apparent that the persons referred to in the execution of the contract of employment.

6. The power of the Contracting Authority to control compliance by the Contractor with the requirements referred to in Article 95 (1) of the Act and the sanctions for failure to comply with those requirements are set out in Section 4 (7) of the SWZ.
