The main purpose of the company is the agricultural recovery of sewage sludge from urban wastewater treatment plants in Arlon, Bastogne Rhin, Marche-en-Famenne, Athus, Eisch Amont (Steinfort) and Dampicourt (Virton) for a period of one year from the date of notification of this contract.
PRECISION ON SLUDGE QUANTITIES:
The quantities mentioned in the price schedule are presumed quantities on the basis of an average production of sludge. The quantities of sludge to be evacuated can therefore be adapted by IDELUX Water according to the actual production of the sludge.
Article 38/12 of the Royal Decree of 14 January 2013: in this case, no compensation can be claimed when, for technical or administrative reasons, the services of the successful tenderer are suspended in one or more treatment plants shut down (breakdown of the dewatering tool) or when the sludge from one or more site(s) is directed to a disposal process other than agricultural recovery due to non-receipt of the certificate of recovery or analysis sludge batches that do not comply with agricultural valorization.
By submitting its tender, the tenderer acknowledges:
- Have examined all the documents made available to it by the contracting authority and have requested and obtained all the useful and necessary information for the preparation of its tender and the assessment of the services;
- Have taken all necessary measures to verify the figures indicated in the tender documents;
- Have prepared its tender according to its own operations, calculations and estimates or on the basis of tender documents but also of information and investigations to which it has deemed necessary to have recourse;
- Have carried out analyses on the sludge, at his own expense, if he deems it necessary;
- Have rectified all errors and omissions so that the company's services are performed in a complete and perfect manner;
- Have included in the fixed prices of the offer all supplies, labor, regional and municipal taxes and any constraints necessary for the perfect course of the evacuation and the treatment of sludge;
- Have taken into account in his submission the risks and special responsibilities that he freely assumes resulting from the execution of the enterprise.
- At the level of the GDPR, the successful bidder must demonstrate that it offers sufficient guarantees as to the implementation of appropriate technical and organizational measures so that the processing meets the requirements of the European regulation on the protection of personal data and guarantees the protection of the rights of the data subject. A note on compliance with their obligations regarding the processing of personal data (GDPR) describing the technical and organisational measures put in place to ensure compliance with the requirements of the GDPR and the protection of the rights of data subjects – maximum 2 pages front A4 (technical and organisational security measures guaranteeing a level of security adapted to the risk, privacy policy, existing procedure in case of personal data breach, GDPR contractual clauses in case of subcontracting, proof of compliance with the GDPR in case of transfer of data to third countries, etc.).
By submitting his tender, the tenderer undertakes to perform the prescribed services and to provide everything necessary for the perfect disposal of the sludge.
The contract may be repeated 3 times for an additional year on the basis of Article 42 § 1, 2 ° of the Law of 17 June 2016 on public procurement.
