The subject of the contract are successive deliveries of diesel fuel ON to the Petrol Station SP ZOZ WSPR in
Białystok in the period covered by the contract, in the dates and quantities indicated by the Ordering Party, but not
longer than 48 hours from the date of order. Deliveries will be made in writing, by phone, e-mail or
by fax order of the Ordering Party.
1. The subject of the contract is the delivery of diesel fuel ON to the Fuel Station SP ZOZ WSPR in Białystok, specified in detail in Annex 1 to SWZ – description of the subject of the contract.
2. The Contractor is obliged to deliver the goods at its own expense and risk to the Fuel Station SP ZOZ WSPR in Białystok at Pogodna 22 Street in Białystok, in the manner described in the attached model contract, constituting Annex 8 to the SWZ.
3. The quantities given in Annex 1 to the SWZ are estimated/forecasted values, which may be reduced during the term of the contract depending on the current needs of the Ordering Party. During the term of the contract, the Ordering Party guarantees an order at the level of 60% of the amount of fuel indicated in Annex 3 to the SWZ as a basic order.
4. The Ordering Party intends to purchase diesel fuel on a scale of 12 months: ON CN: 2710 19 43, CN: 2710 20 11 1200 m³ (where 1000 liters = 1 m3). The purchaser shall have the right of option to increase the quantity of diesel fuel, but not more than by 30 %. The largest possible scope of the order, taking into account the right of option, is up to 1560 m3 of fuel. The Ordering Party reserves the right to use all or part of the contract covered by the right of option, and the Contractor declares that it will not make any claims for this reason.
5. The subject of the order must be in continuous sale, have appropriate certificates and attestations required by Polish law. The fuel offered to the ordering party must meet the standards and quality requirements for liquid fuels in accordance with the Act of 25 August 2006 on the fuel quality monitoring and control system (Journal of Laws of 2022.1315, as amended) and the Regulation of the Minister of Economy of 09.10.2015. on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680). In addition, the fuel should meet the diesel requirements contained in the PN-EN 590 standard or equivalent.
