1. The subject of the contract is the design, delivery, and installation of photovoltaic systems with energy storage for the Municipal Communication Plant in Zawiercie as part of the project titled: 'Development of distributed energy based on RES for public utility buildings in the Zawiercie Municipality 3'.
2. The scope of work includes:

The delivered devices must be unused and factory new manufactured no earlier than in 2026 coming from serial production considering the configuration options provided by the manufacturer for the offered model of equipment and originating from the official distribution channel for the European market. The Ordering Party does not allow prototype equipment, and the applied technology and its individual components should be verified in operating practice.
4. A detailed description of the subject of the contract as well as the description of how to perform parts of the order is included in the Functional-Utility Program (PFU), which is an annex to the SWZ.
5. The Ordering Party also informs that, according to the provisions of the Draft Provisions of the Contract, it will require the Contractor selected in the proceedings during the contract implementation to establish insurance protection (according to the rules specified in the Draft Provisions of the Contract) and to provide security for proper contract performance, in accordance with the contents of the SWZ.
6. The Ordering Party requires the Contractor to provide:
a) product warranty for DC/AC inverters - at least 10 years,
b) product warranty for energy storage - at least 8 years,
c) warranty for other installation equipment minimum 8 years.
7. Time for fault removal - up to 7 working days from the moment of their notification on working days from 7:00 to 15:00.
8. Response time to service requests - up to 48 hours from the moment of notification on working days from 7:00 to 15:00 according to the principles arising from the Agreement.
9. Where in the SWZ, including in the Functional-Utility Program (PFU) or other ordering documents, a trademark, patent, origin, source, or specific process characterizing the products or services provided by a specific Contractor has been indicated or standards, technical evaluations, technical specifications, and systems of technical reference mentioned in Article 101(1)(2) and (3) of the Act, the Ordering Party in accordance with Article 99(5) of the Act allows the submission of an equivalent offer or in accordance with Article 101(4) of the act to offer 'equivalent' solutions in relation to those indicated in the Description of the subject of the order, provided that they ensure obtaining technical parameters not worse than those assumed in the SWZ including PFU.
10. According to Article 101(5) of the Pzp Act, a Contractor who refers to equivalent solutions described by the Ordering Party (in terms of standards, technical evaluations, technical specifications, and systems of technical reference mentioned in Article 101(1)(2) and (3) of the Pzp Act) must prove in the offer, in particular, by means of the evidence referred to in Articles 104-107 of the Pzp Act, that the proposed solutions equivalently meet the requirements specified in the description of the subject of the order.
11. In the case of using equivalent materials or products, the Contractor is obliged to indicate them in the offer and to submit along with the offer technical data sheets or other documents confirming that the offered equivalent solutions meet the requirements specified by the Ordering Party in the description of the subject of the order. In case of a requirement in the Functional-Utility Program for labels or certificates, the Ordering Party accepts all labels confirming that the deliveries or services or construction works meet the equivalent requirements defined by the contracting authority labels and certificates issued by equivalent conformity assessment bodies.
