- Economic operators may request clarifications/additional information, no later than 18 days before the deadline for submitting offers.
- The contracting authority will respond to clarifications/additional information requested by economic operators according to the previous mention, within 11 days before the deadline for submitting offers.
- Any request for clarifications must be sent in SEAP (https://e-licitatie.ro/pub). The number of days within which clarifications can be requested before the deadline for submitting offers/candidatures is established by the contracting authority/entity in the participation announcement/simplified participation announcement, which will be correlated with the final response period, so as to provide sufficient time for economic operators to analyze the allocation documentation and formulate the questions they deem necessary. An example of a formulation that can be used by the contracting authority/entity: “The number of days within which clarifications can be requested before the deadline for submitting offers is 18 days. The contracting authority will clearly and completely respond to all requests for clarifications on the 11th day before the deadline for submitting offers.” In this example, the deadlines for receiving requests for clarifications and for transmitting the contracting authority's response have been calculated so that economic operators benefit from the 10 days provided by Article 161 of Law no. 98/2016, respectively Article 173 of Law no. 99/2016.
