1. The subject of the contract is the delivery of equipment (hereinafter also referred to as: devices) as well as the delivery, implementation, and integration of a comprehensive AI/ML Platform supporting medical and managerial processes in the Regional Specialist Hospital in Grudziądz, along with its launch, user training, and provision of monitoring and technical support in accordance with the Description of the subject of the contract contained in Annex 6 to this SWZ, in the quantities specified in the Price Form constituting Annex 2 to the SWZ and in accordance with the Draft Provisions of the Agreement constituting Annex 4 to the SWZ. The contracting authority allows for the implementation and operation of the AI Platform in a hybrid model, i.e., using local resources (on-premises) and cloud services, while maintaining security, compliance, and data management requirements specified in the description of the subject of the contract contained in Annex 6 to this SWZ.
2. The execution of the Agreement will take place under Contract No. KPOD.07.03-IP.10-0412/25/KPO/656/2025/327 on providing support from the development plan of the project titled “Development of digital services and cybersecurity in the Regional Specialist Hospital in Grudziądz” within the framework of the National Recovery and Resilience Plan Component D “Effectiveness, availability, and quality of the healthcare system” investment D1.1.2 “Accelerating the digital transformation processes in healthcare through further development of digital services in healthcare” established by the Contracting Authority with the State Treasury – Minister of Health.
The DNSH principle, horizontal and sustainable development:
1) The contractor is obliged to implement the subject of the contract in accordance with the principle of “Do no significant harm” (DNSH) for environmental purposes resulting from Article 17 of the Regulation of the European Parliament and Council (EU) 2020/852 of June 18, 2020, and the conditions specified in the Regulation of the European Parliament and Council (EU) 2021/241 of February 12, 2021, establishing the Recovery and Resilience Facility (RRF) and guidelines for the National Recovery and Resilience Plan, and to ensure that actions implemented within the scope of the contract do not cause significant harm to any of the environmental objectives referred to in Article 17 of Regulation (EU) 2020/852.
2) The contractor is obliged to prepare and implement the subject of the contract with respect for the horizontal principles of the EU applicable in the perspective 2021–2027 and for projects financed from the KPO.
3) The contractor is obliged to apply the principle of sustainable development.
The contracting authority informs that in this proceeding conducted in the mode of an unrestricted tender, it anticipates the possibility of applying the procedure referred to in Article 139(1) of the Public Procurement Law. The contracting authority, using the aforementioned procedure, will first conduct an examination and evaluation of the offers, and then qualify the subjective contractor whose offer received the highest score regarding the absence of grounds for exclusion and meeting the conditions of participation in the procedure.
