Description:
Delivery and installation of photovoltaic systems and solar collectors in Kawęczyn Municipality, including project documentation and compliance with quality guarantees for a minimum of 72 months.

1. The subject of the contract is the delivery and installation of photovoltaic systems and solar collectors in a design and build mode.
2. The order has been divided into two parts:

Part I – Delivery and installation of photovoltaics and energy storage in a design and build formula
Part II – Delivery and installation of solar collectors in a design and build formula

The contractor may submit an offer for all or selected parts of the order. The contracting authority does not limit the number of parts to which the order may be awarded to the same contractor.

3. The detailed scope of the subject of the order and the conditions for the implementation of the investment (for both parts of the order) are defined, in addition to the SWZ, by the following documents:
a) Functional and Utility Program “PFU” (attachment no. 12 to the SWZ);
b) Draft provisions of the contract (attachments no. 2a and 2b to the SWZ);
c) Contractor's offer along with attachments,
d) Clarifications to the SWZ (if applicable).
4. The contracting authority requires the contractor to provide quality guarantee and warranty for defects on the completed subject of the order – for a minimum period of 72 months (applicable to parts I and II). NOTE: the period of quality guarantee and warranty for defects on the completed subject of the order constitutes a criterion for evaluating offers (applicable to parts I and II). At the same time, the contracting authority requires warranty periods for the installed devices and installations in accordance with the description contained in the PFU. In the event that the warranty period provided by the manufacturer of the device or installation is longer than the periods specified in the PFU, the manufacturer's warranty period applies.
5. The contracting authority does not foresee awarding contracts under Article 214 section 1 point 7 and 8 of the Public Procurement Law.
6. The contracting authority does not foresee a mandatory site visit.
7. EVIDENTIARY MEANS
7.1. To confirm that the offered subject of the order meets the requirements, features, or criteria defined by the contracting authority that are necessary to conduct the proceedings, the contracting authority requires the submission of relevant evidentiary means along with the offer.
7.2. The contracting authority requires the submission of the following evidentiary means with the offer (applicable to parts I and II):
- technical specification of the offered subject of the order (filled by the contractor in accordance with the template constituting Annex No. 13 to the SWZ for part I and Annex No. 14 to the SWZ for part II),
7.3. If the contractor does not submit the relevant evidentiary means or the submitted relevant evidentiary means are incomplete, the contracting authority will call on the contractor to submit or supplement them within the specified deadline.
8. The subject of the order will be implemented with funding from the Regional Operational Program for the Greater Poland Voivodeship 2021-2027, Priority 10 Just Transformation of Eastern Greater Poland, Action 10.6 Bringing Eastern Greater Poland closer to achieving climate neutrality | European Funds for Greater Poland.
9. The contracting authority will use Article 139 section 1 of the Public Procurement Law, i.e.: The contracting authority will first conduct an examination and evaluation of offers, and then will qualify the contractor whose offer has been highest evaluated, in terms of absence of grounds for exclusion and fulfillment of the conditions for participation in the proceedings.
10. By utilizing the provisions of Article 257 of the Public Procurement Law, the contracting authority informs that it may annul the proceedings for awarding the contract if the public funds that the contracting authority intended to allocate to finance all or part of the order have not been granted to it.
11. (as appropriate for Part I and Part II) The contracting authority requires that the contractor whose offer is chosen as the most favorable provide a performance bond of 3% of the total price (gross) quoted in the offer for the execution of the entire subject of the order. The bond is intended to cover claims due to non-performance or improper performance of the contract. Detailed provisions have been included in Chapter XXIII of the SWZ.


LOT-0001
Part I – Delivery and installation of photovoltaics and energy storage in a design and build formula.
The scope of work for Part I: delivery and installation of photovoltaics and energy storage in a design and build formula:
1) The entire task, i.e. the material scope implemented in the territory of the Kawęczyn municipality includes works that will be carried out in a design and build formula, related to:
- the development of comprehensive, multidisciplinary project documentation, covering all works specified in the functional-utility program regarding the delivery and installation of photovoltaic installations and photovoltaic installations along with energy storage for residential buildings and public utility buildings, preparation of as-built documentation, obtaining legally required opinions, decisions, arrangements, as well as permits and notifications,
- performing works specified in the functional-utility program regarding the delivery and installation of photovoltaic installations and photovoltaic installations along with energy storage for residential buildings and public utility buildings, commissioning of installations, training users, conducting author supervision over the execution of the investment.
Note:
1. The contracting authority requires the execution of the subject of the contract in two stages, namely:
Stage I covering residential buildings and properties of residents
Stage II covering public utility buildings.
2. The contracting authority informs that before commencing installation works, the project documentation will require approval respectively by the resident, the contracting authority, and the Marshal's Office of the Greater Poland Voivodeship. Approval of the documentation does not exempt the contractor from liability for defects and irregularities in the subject of the contract.
2) The contractor will be obliged to carry out all works, services, and inspections that will ensure the validity of the warranties for individual devices/components of the installation – in accordance with the guidelines set by the respective manufacturer of the devices/components of the installation in this regard – throughout the warranty period, as per the proposal submitted during the proceedings.
3) The devices and building materials used by the contractor must:
– be brand new, no older than 2025,
– include an operating and usage manual in Polish,
– possess a written guarantee from the manufacturer or contractor regarding quality,
– be placed on the market in accordance with the provisions of the Act of April 13, 2016 on the systems for the assessment of conformity and market surveillance (Journal of Laws of 2025, item 568),
– have a declaration of conformity with the provisions specified in the EU harmonized legislation and the provisions of the Regulation of the European Parliament and Council (EU) No. 305/2011 of March 9, 2011 establishing harmonized conditions for the marketing of construction products and repealing Council Directive 89/106/EEC - marked “CE” or have a national declaration of performance issued under the provisions of the Act of April 16, 2004 on construction products (Journal of Laws of 2021, item 1213) - marked “B”,
– other requirements regarding photovoltaic installations and energy storage have been specified in the PFU.
3. In order to implement the task, the contractor is obliged at their own expense to supply materials, machines, and equipment necessary for its execution and perform all accompanying works, activities, and actions necessary for the realization of the order. The supplied materials must meet the requirements of products approved for circulation and use in construction. All materials used must be new, meet applicable standards or technical approvals, and possess documents such as: attest, certificate, or compliance certificate.
4. The contractor is obliged to comply with applicable health and safety regulations and fire protection regulations and to secure the work site for the entire duration of the works until the final acceptance of the works.
5. The detailed scope of the subject of the order and the conditions for the execution of the investment (for both parts of the order) are defined, in addition to the SWZ, by the following documents:
a) Functional and Utility Program “PFU” (attachment no. 12 to the SWZ);
b) Draft provisions of the contract (attachments no. 2a and 2b to the SWZ);
c) Contractor's offer along with attachments,
d) Clarifications to the SWZ (if applicable).

6. NOTE: All contents indicated in the Functional-Utility Program constitute starting and auxiliary material for the contractor to prepare their own works for the execution of individual tasks that together form the subject of the order. In the case of discrepancies in solutions presented by the contracting authority and those developed by the contractor, the contractor shall not claim rights to additional remuneration.
7. The contracting authority requires the contractor to provide a quality guarantee and warranty for defects on the completed subject of the order – for a minimum period of 72 months (applies to parts I and II). NOTE: the period of quality guarantee and warranty for defects on the completed subject of the order is a criterion for evaluating offers (applies to parts I and II). At the same time, the contracting authority requires warranty periods for the installed devices and installations in accordance with the description contained in the PFU. In the event that the warranty period provided by the manufacturer of the device or installation is longer than the periods indicated in the PFU, the manufacturer's warranty period applies.


LOT-0002
Part II – Delivery and installation of solar collectors in a design and build formula.
Part II of the order involves the delivery and installation of solar collectors in a design and build formula:
1) development of comprehensive, multidisciplinary project documentation, covering all works specified in the functional-utility program regarding the delivery and installation of solar collectors for domestic hot water (DHW) generating thermal energy with DHW storage tanks of 200 liters or 300 liters in individual households, preparation of as-built documentation, obtaining legally required opinions, decisions, arrangements, as well as permits and notifications,
2) performing works specified in the functional-utility program regarding the delivery and installation of solar collectors, conducting author supervision over the execution of the investment.

3) The contractor will be obliged to carry out all works, services, and inspections that will ensure the validity of the warranties for individual devices/components of the subject of the order – in accordance with the guidelines set by the respective manufacturer of the devices/components of the installation in this regard – throughout the warranty period, as per the proposal submitted during the proceedings.
