1. The subject of the contract is the delivery of medical equipment. The subject of the contract has been divided into 5 parts/Packets, each of which constitutes a separate subject of the contract: package no. 1 – Integrated staining and covering set: Automatic dyeing device, automatic covering device package no. 2 – Vacuum tissue processor package no. 3 – Semi-automatic microtome package no. 4 – Tissue processor package no. 5 – Embedding device – Three-module embedding line 2. The detailed description of the subject of the contract is included in Annex 1a to the SWZ. 3. The subject and terms of execution of this contract must comply with the Act of April 7, 2022, on medical devices and the Regulation of the European Parliament and Council (EU) 2017/745 of April 5, 2017, on medical devices or the Regulation of the European Parliament and Council (EU) 2017/746 of April 5, 2017, on in vitro diagnostic medical devices (if applicable) and with other applicable legal provisions in this regard. The offered devices must have a CE declaration. 4. The devices must be approved for circulation and use on the territory of the Republic of Poland in health care facilities, in accordance with applicable legal regulations (declaration of compliance for the entire device, CE marking, registration or entry of the medical device with the President of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products). 5. The subject of the contract must be complete, ready for use after unpacking, installation, and commissioning without any additional purchases and investments. The subject of the contract should be produced in 2025. 6. The offered subject of the contract must be factory new, unused, and not displayed at exhibitions or trade fairs, not being the subject of scientific research, development work, research services, not being a demonstration object and refurbished, never previously used for any purpose by another entity, technically efficient, safe, complete, and ready for work, and must meet the technical-functional requirements specified in the description of the subject of the contract. 7. The contracting authority does not foresee the possibility of granting orders mentioned in Art. 214 sec. 1 item 8 of the Public Procurement Law. 8. As part of the implementation of the subject of the contract, the Contractor will be obliged to conduct necessary training for the Contracting Authority's staff regarding the use of the offered equipment at the Contracting Authority's premises. 9. The contractor will provide warranty for defects and quality assurance for the subject of the contract for a minimum period of 24 months (the warranty period constitutes a criterion for the evaluation of offers). 10. The subject of the contract is financed as part of the implementation of the investment task titled 'Purchase of equipment under the National Oncology Strategy titled 'Purchase of equipment for pathological diagnostics' in 2025.' 11. The Contracting Authority plans to annul the proceedings if the public funds that it intended to allocate for the financing of all or part of the contract are not allocated. 12. The contracting authority requires separate invoicing for each item (the name on the invoice must be the same as the naming in the packages).
