1. The subject of the order is to provide service, technical support, updates, and author supervision over the X-ray dose monitoring system owned by the Ordering Party for a period of 36 months as part of the project entitled Digital Transformation, Improvement of Data Security, and Integration of Hospital Systems of the Health Care Team in Skarżysko-Kamienna Maria Skłodowska-Curie County Hospital in order to increase the efficiency, availability, and quality of health care from the National Recovery and Resilience Plan: Investment D1.1.2. A detailed description of the subject is contained in Annex No. 1 to the SWZ.
2. The purchase is implemented under the project entitled “Digital Transformation, Improvement of Data Security, and Integration of Hospital Systems of the Health Care Team in Skarżysko-Kamienna Maria Skłodowska-Curie County Hospital to increase the efficiency, availability, and quality of health care”, co-financed by EU funds under the National Recovery and Resilience Plan, Component D “Efficiency, Availability and Quality of the Health Care System”, Investment D1.1.2 “Accelerating the processes of digital transformation in healthcare through further development of digital services in healthcare.”
3. The Contractor, if his offer is selected as the most advantageous, will be required to insure himself against civil liability in the scope of activities performed in the implementation of the subject of the contract, for a minimum value presented in the Contractor's Offer, for the entire period of implementation of the subject of the contract. The Contractor will be required to present, before signing the contract, the insurance policy or other insurance document confirming (along with proof of payment of the insurance premium) that he is insured in accordance with the above requirements.
4. The Ordering Party, in reference to the provisions of Article 95 of the Pzp Act, informs that it requires the Contractor or Subcontractor to have activities directly related to the implementation of the subject of the contract performed by person(s) employed by the Contractor or Subcontractor under an employment contract (in any form), within the meaning of the provisions of the Act of June 26, 1974 Labor Code. The Ordering Party recognizes activities directly related to the implementation of the subject of the contract include actions in the following scope: activities regarding maintenance services, service of the HIS-class IT system, and performing updates of the IT system and carrying out activities related to technical support.
5. The offered subject of the order must meet environmental requirements regarding its implementation in accordance with the No Significant Harm (DNSH) principle as defined in Regulation of the European Parliament and of the Council (EU) 2020/852 (the so-called EU Taxonomy) of June 18, 2020 and will not: a) lead to significant greenhouse gas emissions b) cause the aggravation of adverse effects of current and expected future climatic conditions impacted on this activity or on people, nature, or assets; c) harm the good status or ecological potential of the uniform parts of waters, including surface and groundwater, nor the good status of the marine environment; d) lead to: - significant inefficiencies in the use of materials or in the direct or indirect use of natural resources (such as non-renewable energy sources, raw materials, water, and land) at at least one stage of the product life cycle, including in terms of durability, as well as the possibility of repair, improvement, reuse, and recycling; - significant increases in the generation, incineration, or disposal of waste, except for the incineration of non-recyclable hazardous waste; - long-term storage of waste that may cause serious and long-term damage to the environment; - lead to significant increases in emissions of pollutants into air, water, or soil compared to the situation before the start of the project. The Contractor is obliged to provide documents confirming compliance with the DNSH principle and to provide explanations in this regard at the request of the Ordering Party. A declaration in order to confirm compliance of the offered supplies with the requirements specified in the description of the subject of the order, including the DNSH principle – the template for the declaration is provided in Annex No. 7 to the SWZ.
6. The Contractor is also obliged, in the performance of the task, to act in accordance with the principles of equal opportunities and non-discrimination and the principle of gender equality, among others, by: a) ensuring that women and men, as well as persons with disabilities, equally with other able-bodied individuals, under the same conditions, have access to full participation in the project at every stage of its implementation; b) observing the principles of gender equality and non-discrimination based on disability in selecting the team of employees responsible for implementation (experience and scope of previous duties will be taken into account); c) managing the implementation of the task considering the principle of equal opportunities; d) no restrictions on access to resources produced on the grounds of gender, racial or ethnic origin, religion or beliefs, disability, age or sexual orientation.
7. The Contractor is also obliged to: a) the implementation of the contract shall not in any way limit the attribution of the same social value, equal rights and obligations, equal access to resources to women and men or persons with disabilities; b) no differentiation, exclusion or limitation will be applied based on gender or disability; c) products and results will be available to all users, including those with disabilities and without restrictions based on gender.
