Number of days before the deadline for submitting offers/applications during which clarifications can be requested: 20 days.
The contracting authority will respond clearly and completely to all clarification requests: on the 11th day before the deadline set in the participation announcement for submission of offers.
Any request for clarifications must be submitted via SEAP (https://www.e-licitatie.ro).
Completion of the award procedure by concluding the public procurement contract is subject to the following suspensive condition, which will operate for a maximum period of 3 months from the offer submission deadline:
The conclusion of the public procurement contract is conditioned upon maintaining the financing within the research project TERȚI 855/2026; signing the contract is possible only if the provisions regarding the commitment of expenditures from budgets subject to public finance legislation are respected, and with compliance with the provisions of Decision no. 395/2016 approving the Methodological Norms for applying the provisions regarding the award of the public procurement contract/framework agreement from Law no. 98/2016 on public procurement, with subsequent amendments and completions.
If, for any reason whatsoever, the financing within the research project TERȚI 855/2026 is not maintained, the contracting authority will apply the provisions of Art. 212 para. (1) letter c) second sentence of Law no. 98/2016, with subsequent amendments and completions, making it impossible to conclude the public procurement contract.
Bidders in this procedure understand that the Contracting Authority and/or MEC cannot be held liable for any damages in case of cancellation of the award procedure, regardless of their nature and whether the Contracting Authority and/or MEC were notified of the existence of such damages.
Bidders in this procedure accept the above special conditions/suspensive clause, assuming full responsibility for any potential damages they might suffer in the described situation.
