The subject of the procurement procedure is to conclude a framework agreement without reopening the competition between the contracting authority and one contractor, under which partial public contracts for services consisting of the collection and disposal of sludge from the contracting authority's wastewater treatment plants and other related services will be awarded to the selected contractor.

The contracting authority will conclude a framework agreement with a single contractor who meets the conditions of the procurement documentation (especially qualification conditions and other participation conditions) and whose bid will be evaluated as the most advantageous according to the ranking of offers. The partial public contracts based on the concluded framework agreement will subsequently be awarded by the contracting authority in accordance with the provisions of § 134 of the law using the procedure without reopening the competition (with a single participant).

The subject of the fulfillment of the public contracts awarded on the basis of the framework agreement will be services consisting of the collection of stabilized, dewatered sludge from the treatment of municipal wastewater, including ensuring its transport from the wastewater treatment plants and its further utilization or other disposal, according to the partial implementation contracts of the contracting authority carried out according to the current needs and demand of the contracting authority, and possibly other related services. The conclusion of the framework agreement does not give the selected contractor, with whom the framework agreement was concluded, the right to payment, this right will arise for the contractor only based on the realization of a partial public contract executed on the basis of a concluded implementation contract for a partial public contract.

The subject of performance of the public contracts awarded on the basis of the framework agreement is specified in more detail in the draft framework agreement (Annex No. 3 of the procurement documentation) and in the specification of the subject of performance (Annex No. 4A of the procurement documentation). The contracting authority further lists the quality of the sludge in the form of chemical analyzes of the sludge based on laboratory results for the year 2024 (Annex No. 4B of the procurement documentation).
