The subject of the contract is the delivery and installation of infrastructure elements for research on material simulations based on machine learning within the project entitled "Polish Network of Research Infrastructure for Exact Sciences Supported by Artificial Intelligence." 2. Detailed requirements regarding the subject of the contract are an integral part of the description of the subject of the contract and are included in Part IV of the SWZ, where, according to the content of Article 99(6) of the Public Procurement Law, the contracting authority has indicated the criteria used for assessing equivalence. 3. The contractor is obliged to provide the contracting authority with a quality warranty under the conditions of the manufacturer's warranty. Warranty requirements have been specified in Part III and IV of the SWZ. 4. The warranty period will be counted from the date of preparation of the acceptance protocol for the subject of the contract. 5. The delivered subject of the contract must be brand new, not displayed, complete, and technically functional. The term "brand new" means a subject of the contract that is originally packaged, not used before the day of delivery, excluding the use necessary to conduct tests of its correct operation after production. 6. The subject of the contract must be free from any physical and legal defects and claims by third parties. 7. The delivered subject of the contract must come from the manufacturer's distribution channel that does not exclude distribution to the Polish market and ensures the execution of warranty rights. 8. The subject of the contract must be delivered with user manuals, drivers, and any accompanying software necessary for the proper use of the subject of the contract (to achieve full functionality indicated in Part IV of the SWZ). The contracting authority will not be obliged to pay any additional fees, particularly licensing fees, while any licenses will be granted within the contractor's remuneration, without time and territorial limitations unless otherwise explicitly stated in Part IV of the SWZ. If licenses, codes, or other authorizations are needed to start and use this software, they must be provided at no additional cost. Codes, licenses, and other authorizations must also be delivered if they are necessary to start or configure hardware components. 9. The delivered subject of the contract intended to be powered from the electrical network must be equipped with an appropriate number of power cables allowing it to be connected to standard power sockets unless explicitly stated otherwise in Part IV of the SWZ. 10. The offered subject of the contract on the date of submission of the offer must not be planned by the manufacturer for discontinuation from production or sale. 11. The offered subject of the contract must have CE marking or a declaration of conformity with CE. In cases where the offered subject of the contract is not subject to CE marking requirements, it must have a declaration of conformity with the RoHS directive or be marked with the RoHS sign - the items subject to marking are specified in Part IV of the SWZ. 12. The offered subject of the contract - equipment, and if justified by the size or function of the equipment - on the packaging and documents attached to the equipment, must be marked with the symbol for selective collection (crossed container) - items subject to marking are specified in Part IV of the SWZ. 13. Each of the "A" type computing servers must contain information regarding reuse and recycling, must not contain paints and coatings on large plastic parts that cannot be recycled or reused. All components containing electronic parts and hazardous ingredients should be removable. The removal of materials and components should be carried out in accordance with the requirements of the WEEE Directive 2002/96/EC. Each of the "A" type computing servers must consist of at least 65% of reusable/recyclable components. All plastic parts (of the assortment/elements being the subject of the contract) heavier than 25 grams may contain only trace amounts of flame retardants classified under Directive RE 67/548/EEC. Confirmation of compliance with the above requirement is a printout from the www.epeat.net website confirming compliance with the standard of at least EPEAT Bronze Climate+.
