Description:
Preparation of design and cost documentation for the construction of two water retention reservoirs in the Prudnik Forest District, including environmental inventory and obtaining necessary permits.

The procedure titled “Preparation of design and cost documentation as part of the Comprehensive Project for the adaptation of forests and forestry to climate change – small retention and prevention of water erosion in mountain areas – continuation (MRG3) for two tasks in the Prudnik Forest District”
Preparation of design and cost documentation with elements of environmental and forestry inventory along with obtaining a construction permit for:
Part 1. task titled “Development of complete design documentation along with an environmental inventory and obtaining all required approvals for the task titled 'Construction of two water retention reservoirs in the Kubice forestry plot 184 b'
Part 2 – task titled “Development of complete design documentation along with an environmental inventory and obtaining all required approvals for the task titled 'Construction of two water retention reservoirs in the Lipowa forestry plots 191 g and 193 b'”
2. The subject of the contract includes preparing the following documentation for each part:
a) Before starting the preparation of design and cost documentation, environmental inventory should be conducted for each part separately, which includes:
- the occurrence of protected species in the project and during its implementation (e.g., delineation of technology roads to avoid damaging habitats)
- assessment of the impact of implemented activities on ecosystems (monitoring before and after implementation)
The most important elements of the inventory are:
- mapping of the area’s vegetation based on phytosociological photos
- assessment of the degree of transformation of individual phytocenoses based on their species composition and structure
- identification of the distribution of natural habitats important from the perspective of the Natura 2000 program
- assessment of the impact of activities on ecosystems
- inventory of protected plant species, including vascular plants and bryoflora
- inventory of fauna with particular emphasis on batrachofauna, ornithofauna, ornithopterofauna, and odonatofauna
b) Obtaining a complete set of required decisions, permits, and agreements necessary to obtain a final and legally binding decision on the construction permit in accordance with the Building Law of July 7, 1994 (Dz. U. 2024 poz. 725)
c) The contractor is obliged to act as an expert in the public procurement process for construction works and to respond to questions raised within 2 days from the submission of questions for processing.
d) Performing Author Supervision throughout the entire duration of construction works,
e) The contractor undertakes to provide a three-time free update of the investor's cost estimate.
f) The cost of obtaining necessary permits and decisions is borne by the contractor, and the contracting authority will provide the necessary authorizations.
3. The design and technical documentation should include:
3.1 Stage I – development and approval at the contracting authority of the design concept including:
- project purpose map – 1 copy.
- geotechnical documentation – 1 copy.
- land development project – 1 copy.
- technical description of design solutions – 1 copy.
- investor's cost estimate – 1 copy.
3.2 Stage II – conceptual and research work:
1) preparation of geotechnical documentation – 3 copies in paper version for the contracting authority + copies for approvals and permits;
2) preparation of the Project Information Card (if necessary) – 3 copies in paper version for the contracting authority + copies for approvals;
3) notification of actions in accordance with Article 118 of the Act of April 16, 2004 on nature conservation.
4) obtaining water law consent – depending on the parameters of the investment, it will be a water law assessment, water law permit, or water law notification,
5) obtaining a declaration of compliance with environmental objectives from the Polish waters for investments that have an environmental conditions decision, water law assessment, water law permit or have made a water law notification,
6) obtaining the so-called responsible authority's information on water management issued based on the Agreement on issuing a document confirming compliance with environmental objectives for projects implemented under cohesion policy on May 20, 2024, concluded between the Minister of Funds and Regional Policy and the President of the State Water Holding Polish Waters,
7) obtaining from the relevant Regional Directorate for Environmental Protection a Natura 2000 declaration required for investments applying for EU funds,
8) preparation of land development project 3 copies in paper version for the contracting authority + copies for approvals and permits
9) preparation of architectural and construction design - 3 copies in paper version for the contracting authority + copies for approvals and permits
10) preparation of technical project - 3 copies in paper version for the contracting authority
11) preparation of attachments - 3 copies in paper version for the contracting authority + copies for approvals and permits
12) preparation of technical specifications for the execution and acceptance of construction works – 3 copies in paper version for the contracting authority;
13) preparation of the bill of quantities – 3 copies in paper version for the contracting authority;
14) preparation of the investor's cost estimate using detailed calculation method – 3 copies in paper version for the contracting authority;
15) transfer of a complete set of project documentation in electronic version
16) the bills of quantities and investor's cost estimates should also be provided in electronic version on a pendrive in PDF format and in editable version (*ath) in 2 copies.
3.3 Stage III - obtaining a legally binding decision approving the construction project and granting a construction permit, and providing documentation that will ultimately serve as a description of the subject of the order in the procedure for awarding the contract for the performance of construction works, including:
1) obtaining a final decision approving the construction project and granting the construction permit;

1. Execution of design and cost documentation with elements of natural-forest inventory along with obtaining a building permit for:
Part 2 - “Development of complete project documentation along with natural inventory and obtaining all required agreements for the task titled ‘Construction of two retention water reservoirs in the Lipowa forestry sections 191 g and 193 b’”
2. The subject of the order includes the execution of the following documentation for each part:
a) Before proceeding with the preparation of the design-cost documentation, a natural inventory must be carried out for each part separately, which considers:
- occurrence of protected species in the project and during its implementation (e.g., such delineation of technological roads to avoid damaging stands)
- assessment of the impact of implemented actions on ecosystems (monitoring before and after implementation)
The most important elements of the inventory are:
- mapping of the vegetation of the area based on phytosociological photographs
- assessment of the degree of transformations of individual phytocoenoses based on their species composition and structure
- identification of the distribution of natural habitats significant from the perspective of the Natura 2000 program
- assessment of the impact of actions on ecosystems
- inventory of protected plant species, both vascular plants and bryophytes
- inventory of fauna, with particular emphasis on amphibians, birds, orthopterans, and odonates
b) Obtaining a complete set of required decisions, permits, and agreements necessary to obtain a final and legally valid building permit in accordance with the Building Law of July 7, 1994 (Journal of Laws 2024 item 725)
c) The contractor is obliged to act as an expert in the public procurement proceedings for construction works and to provide answers to questions posed within 2 days from the submission of the questions for preparation.
d) Conducting Author's Supervision throughout the entire duration of the construction works,
e) The contractor undertakes to provide three free updates of the investment cost estimate.
f) The cost of obtaining necessary permits and decisions lies with the Contractor, and the Ordering Party will provide necessary authorizations.
3. The design and technical documentation should include:
3.1 Stage I - preparation and approval by the Ordering Party of the project concept regarding:
- project map – 1 copy.
- geotechnical documentation – 1 copy.
- land development project – 1 copy.
- technical description of project solutions – 1 copy.
- investor's cost estimate – 1 copy.
3.2 Stage II – design and research work:
1) preparation of geotechnical documentation – 3 paper copies for the Ordering Party + copies for agreements and permits;
2) preparation of the Project Information Card (if necessary) – 3 paper copies for the Ordering Party + copies for agreements;
3) making a notification of actions in accordance with Article 118 of the Act of April 16, 2004 on nature conservation.
4) obtaining water law approval – depending on the parameters of the investment, it will be a water legal assessment, water law permit, or water law notification,
5) obtaining a declaration of compliance with environmental objectives from the Polish Waters for investments that have an environmental conditions decision, water law assessment, water law permit, or a water law notification has been made,
6) obtaining the so-called information from the competent authority for water management issued based on the Agreement on issuing a document confirming compliance with environmental objectives for projects implemented under cohesion policy dated May 20, 2024, concluded between the Minister of Funds and Regional Policy and the President of the State Water Holding Polish Waters,
7) obtaining a declaration from the relevant Regional Directorate for Environmental Protection required for investments applying for EU funds,
8) preparing a land development project 3 paper copies for the Ordering Party + copies for agreements and permits
9) preparing an architectural and construction project - 3 paper copies for the Ordering Party + copies for agreements and permits
10) preparing a technical project - 3 paper copies for the Ordering Party
11) preparing attachments - 3 paper copies for the Ordering Party + copies for agreements and permits
12) preparing the technical specification for the execution and acceptance of construction works – 3 paper copies for the Ordering Party;
13) preparing a bill of quantities – 3 paper copies for the Ordering Party;
14) preparing an investor's cost estimate using detailed calculation methods – 3 paper copies for the Ordering Party;
15) transferring a complete set of project documentation in electronic version
16) bills of quantities and investor’s estimates should also be submitted in electronic version on a USB drive in PDF format and in editable version (*ath) in 2 copies.
3.3 Stage III - obtaining a valid decision approving the construction project and granting a building permit and providing documentation that will ultimately serve as a description of the subject of the order in the proceedings for granting the order for construction works, including:
1) obtaining the final decision approving the construction project and granting a building permit;
