The subject of the contract in accordance with the Functional-Utility Program and the draft contract, which are annexes to the Terms of Reference (ToR), is the development of project documentation along with the supply and execution of installation works, i.e.: 136 photovoltaic installations with energy storage, 37 photovoltaic installations, 20 heat pumps, located in the city of Bełchatów under a design and build formula. The contract will be executed based on the Functional-Utility Program, which is an integral part of the contract.
This contract is co-financed by the European Regional Development Fund under the Regional Program European Funds for Łódź Voivodeship 2021 – 2027. Activity FELD.02.24 Renewable Energy Sources – ZIT Radomsko-Piotrków Trybunalski-Bełchatów, Priority FELD.02 European Funds for a Green Łódź Voivodeship, implemented under the task: "Purchase and installation of renewable energy installations in residential buildings in the City of Bełchatów." The contracting authority foresees the application of the procedure referred to in Article 139(1) of the Public Procurement Law (PZP), i.e., the possibility of applying the so-called reversed order of evaluation of bids. In this case, the contracting authority will first examine and evaluate the bids and then qualify the contractor whose bid has been rated highest in terms of no grounds for exclusion and fulfillment of conditions for participation in the proceedings. A list of documents confirming grounds for exclusion and compliance with participation conditions as well as grounds for exclusion - in accordance with the provisions of the ToR available at: https://platformazakupowa.pl/transakcja/1325003. According to the draft contract annexed to the ToR, the contracting authority foresees the possibility to amend the concluded contract in relation to the content of the selected offer within the scope specified in the draft contract. 4. The contract is not divided into parts. The contracting authority does not allow partial bids. Detailed justification is given in the tender documents.
5. The contracting authority does not allow variant bids or bids in the form of electronic catalogs.
6. The contracting authority does not envisage awarding contracts referred to in Article 214(1)(8) of the Public Procurement Law.
7. Detailed description and method of contract execution is contained in the Functional-Utility Program and draft contract annexed to the ToR.
8. Warranty and guarantee:
- required warranty period for the performed subject matter of the contract: minimum 60 months, counting from the date of final acceptance;
- required guarantee period for the performed subject matter of the contract: minimum 60 months, counting from the date of final acceptance.
NOTE: award criterion of the bid.
Contract execution deadline: 4 months.
2. Installations with heat pumps must be executed and commissioned by 15.10.2026.
3. Detailed issues concerning the contract execution deadline are regulated in §4 of the draft contract – annex to the ToR.
STATEMENTS AND DOCUMENTS TO BE PROVIDED BY CONTRACTORS TO CONFIRM NO GROUNDS FOR EXCLUSION AND TO PROVE COMPLIANCE WITH CONDITIONS FOR PARTICIPATION
1. The contractor is obliged to attach to the offer the following documents valid on the day of bid submission:
1) completed and electronically signed Tender Form prepared according to the template in the annex to the ToR;
2) completed and electronically signed statement concerning exclusion grounds pursuant to Article 5k of Regulation No 2022/576 of 8 April 2022 amending Council Regulation (EU) No 833/2014 regarding restrictive measures related to destabilizing actions by Russia in Ukraine and Article 7(1) of the Act on special solutions to prevent support for aggression against Ukraine and to protect national security – according to the template in the annex to the ToR;
3) completed and electronically signed statement of the entity providing resources concerning exclusion grounds pursuant to Article 5k of Regulation No 2022/576 dated 8 April 2022 and Article 7(1) of the Act – according to the template in the ToR, if applicable;
4) completed and electronically signed commitment of the entity providing resources to concede necessary resources to the contractor for executing the order (legal basis Art.118(3) PPL) – according to the annex to the ToR; or other documentary evidence proving that the contractor will have at its disposal the necessary resources of these entities – if applicable;
5) completed and electronically signed statement of contractors jointly applying for the contract under Article 117(4) of the PPL dated 11 September 2019 – according to the template in the annex to the ToR – if applicable.
6) Other necessary documents for the procedure:
a) documents proving the authorization of persons to represent the contractor, especially an extract or information from the National Court Register or other relevant register;
b) power of attorney for representation in the public procurement procedure or in concluding the contract in case of joint contractors applying for the contract.
2. Before selecting the most advantageous offer, the contracting authority will call the contractor whose offer was ranked highest to submit within a designated deadline a statement on the absence of exclusion grounds and fulfillment of participation conditions, using the European Single Procurement Document (ESPD) form referred to in item 1) in Chapter IX of the ToR available at: https://platformazakupowa.pl/transakcja/1325003.
