The subject of the procurement is the execution of design and supervisory tasks related to the investment to be implemented within the framework of the project titled "Active Tourism Development in Miskolc–Lillafüred" with identification number TOP_PLUSZ-6.2.1-23-MI1-2025-00002. The aim of the development is to renew and functionally develop the environment of Lake Hámori for active tourism in a nature-friendly manner, to increase the touristic and active tourism attractions of the region, and to improve the safety and comfort of pedestrian and recreational use while ensuring the preservation of natural and landscape values. The design tasks cover the preparation of three interdependent functional and spatial development elements: – planning the renovation of the existing waterfront promenade on the southwestern side of Lake Hámori, designing durable pavements suited to environmental conditions, solutions improving the safety and comfort of pedestrian traffic, along with the necessary alignment adjustments, drainage solutions, and environmental considerations; – planning the creation of a lakeside walkway along Lake Hámori, near the Ómassa road, examining the creation of an experience-based pedestrian path aiming to substitute the currently unsuitable segment for pedestrian traffic, developing a technical solution ensuring pedestrian traffic using a boardwalk structure anchored to the lakebed, without disturbing the bank; the material usage and structural design of the walking surface should be determined during the design process based on the results of static, geotechnical, hydraulic and environmental studies, with special regard to the impact on the Natura 2000 area; – designing a resting point and viewing terrace at the junction of the waterfront and lake walkway, examining the technical and spatial possibilities of a facility providing recreational functions that fits into the natural environment and highlights landscape values. The project is in the project development phase, so the planned quantities in the Design Program, which is an annex to the Invitation to Tender, are indicative. The precise routing, length, and technical design of the development elements will be determined based on the design process and the results of consultations with authorities, nature conservation, and property management. The planned investment affects the Natura 2000 area and the operational area of the Bükk National Park Directorate, hence the Designer's task includes preparing the necessary nature conservation, water regulation, and other official documentation and conducting consultations and obtaining necessary approvals with the affected organizations, especially with BNPI, Északerdő Zrt., Magyar Közút Nonprofit Zrt., and the Hungarian Hiking Association. The Designer is obliged to perform the design tasks in accordance with the provisions of Act LXIX of 2023 on the order of state construction investments and the provisions of the 25/2024. (VIII. 8.) ÉKM decree on the system of construction investment processes, complete with preparing comprehensive authorization and execution plans, coordinating specialty designers, and providing design supervision. Considering the nature of the investment and the site's conditions, obtaining a building permit, and a water rights establishment permit due to interventions affecting the water surface and bed is necessary for implementation. The planned investment affects the Natura 2000 area and the operational area of the Bükk National Park Directorate (BNPI); therefore, the Designer's task involves conducting a Natura 2000 impact assessment, compiling necessary nature conservation technical documentation, and obtaining permits and regulatory opinions from BNPI and competent environmental and forestry authorities. The realization of the planned facilities requires obtaining a road management contribution concerning the affected road infrastructure, and given the forestry classification of the area, the Designer is obliged to consult with the manager of the affected state forest area, Északerdő Zrt., to obtain a forest utilization permit. As the project's commitment includes connecting the Lake Walkway (along Ómassa road) to the national marked tourist trail network as a tourist path, the Designer is obliged to consult with the Hungarian Hiking Association. The Designer must consider and incorporate the route, signage, and design requirements determined by the Association into the plans. The Designer must consult with BNPI during the design process, and fully incorporate into the plans all nature conservation conditions prescribed by BNPI, particularly regarding avoiding light pollution, creating the shore and lake walkway, anchoring the boardwalk structure, routing restrictions, and landscaping. When setting the end point of the walkway, the Designer must involve the BNPI nature conservation ranger service. The Designer's task includes the comprehensive assurance of compliance with the provisions for designers as per Act LXIX of 2023 (hereinafter: Ábtv.) and the 25/2024. (VIII. 8.) ÉKM decree on the system for construction investment processes and designer services, as well as the designation of a state-owned economic entity participating in quality assurance of state construction investments, until the successful conclusion of the technical acceptance procedure. The designer, as the responsible designer of the state construction investment (ÉBFR § 8 (1)), is obliged to prepare the complete design documentation necessary for implementation, including specialty designs, coordinate the work of specialist designers, obtain all necessary permits and consents for implementation on behalf of the client, and provide design supervision (ÉBFR § 8 (2)). BT-728 continuation: The Designer is obligated to enforce the principle of local water retention [147/2010. (IV.29.) Governing decree § 4 (6)] and present the planned solution in the technical documentation. The Designer must demonstrate the method of preserving biological activity (Natura 2000, BNPI regulations) in the design documentation and issue a design declaration on it. The Designer commits to a minimum warranty of 36 months for the complete design documentation, covering all design errors, deficiencies, and their consequences arising during the warranty period. There is no provision for partial bidding. The design task, which forms the subject of the procurement, requires a unified design concept and coordinated authorization preparation for development elements in the environment of Lake Hámori, which are in close functional, spatial, and technical connection – renovation of the waterfront promenade, creation of the lakeside walkway, and the design of a resting point and viewing terrace. During the design of development elements, simultaneous, interacting examinations from static, geotechnical, water regulation, traffic, nature conservation, and landscape architecture perspectives are necessary, which can only be ensured under unified design responsibility and coordination. Dividing the design task among multiple bidders would pose significant coordination and authorization risks, result in parallel authority and professional authority procedures, and endanger the technical coherence of the design documentation. The investment affects a Natura 2000 area and the operational area of the Bükk National Park Directorate, hence unified handling of nature conservation, water regulation, and property management authorization procedures cannot be ensured if the design task is divided. Safe and feasible project preparation can only be guaranteed by a single bidder under a single contract.
