Supply and installation of equipment under the project DEVELOPMENT OF GENOMIC RESEARCH IN ROMANIA (ROGEN), project code 324809, submitted under the project call PS/272/PS_P5/OP1/RSO1.1/PS_P5_RSO1.1_A9 - Support for the implementation of research solutions of strategic importance in the medical field: genomics; non-communicable diseases (e.g. development of research solutions for cancer treatment); vaccines, serums and other biological medicines
The procurement is structured in 6 lots, named:

This procedure is initiated by Carol Davila University of Medicine and Pharmacy Bucharest on behalf of the following contracting authorities:
- Fundeni Clinical Institute, located in Bucharest, Fundeni Road no. 258, sector 2, fiscal code RO 4204003,
- Ștefan S. Nicolau Institute of Virology, located in Bucharest, Mihai Bravu Road no. 285, sector 3, fiscal code 4221209,
- Prof. Dr. I. Chiricuță Oncology Institute Cluj-Napoca, located in Cluj-Napoca, Republicii Street no. 34-36, fiscal code 4547125,
The execution of the contract is subject to the Suspensive Clause.
The award procedure for the public procurement contract is initiated under the incidence of this suspensive clause, meaning that concluding the public procurement contract is conditioned by the allocation of budgetary credits for this purpose, the contract signing being done in compliance with provisions related to the commitment of expenses from budgets under the legislation on public finances.
Considering the provisions of Law no. 98/2016 on public procurement and Government Decision no. 395/2016, with subsequent amendments and completions, Carol Davila University of Medicine and Pharmacy Bucharest, as Contracting Authority, specifies that it will conclude the contract with the winning bidder only to the extent that the necessary funds for the purchase are ensured. In case, for any reason, the funds related to this procurement procedure are not allocated within 6 months from the approval date of the Procedure Report, the award procedure will be legally cancelled, provided there is no other funding source, in accordance with the provisions of art.212 para.(1) letter c) second phrase of Law 98/2016 with subsequent amendments and completions, making it impossible to conclude the public procurement contract. Bidders are obliged to maintain their offer submitted within the procurement procedure valid and unchanged until the signing of the public procurement contract. Bidders in this procedure understand that the Contracting Authority cannot be held responsible for any prejudice resulting from the cancellation of the award procedure, regardless of its nature and whether the Contracting Authority was notified of such prejudice. Bidders accept the use of the above special conditions/suspensive clause, assuming full responsibility for any damages they might suffer in the described situation. The maximum period for which the suspensive clause operates is 6 months, so if the condition of signing the financing contract is not fulfilled, the award procedure is cancelled.
