Description:
The contracting authority is seeking to acquire medical equipment for the Laboratory of Pathological Anatomy as part of the 'AI-Assisted Robotic and Laparoscopic Surgery System' project, including a complete automatic system for IHC, ISH, and FISH, and a histological slide scanning system, contingent upon securing project funding.

The contracting authority seeks to conclude public procurement contracts for the acquisition of medical equipment within the project 'AI-Assisted Robotic and Laparoscopic Surgery System' - Stage I - equipment for the Laboratory of Pathological Anatomy, in accordance with the technical specifications attached to the terms of reference, as follows:
Lot 1: Complete automatic system for IHC, ISH, and FISH;
Lot 2: Histological slide scanning system.

The deadline by which the Contracting Authority will respond clearly and completely to all qualification requests/additional information: On the 11th day before the deadline for submitting offers. - Number of days until when clarifications can be requested before the deadline for submitting offers/candidatures: 19.

Complete automatic system for IHC, ISH, and FISH.
Complete automatic system for IHC, ISH, and FISH - 1 unit.
According to the terms of reference and the attached technical specifications.

Suspensive clause:
The award procedure will be initiated under the incidence of this suspensive clause, meaning that the conclusion of the public procurement contract is conditioned on obtaining funding for the project 'AI-Assisted Robotic and Laparoscopic Surgery System' within the HEALTH PROGRAM: 'Support for compatible STEP projects submitted in the health project ideas call run by AM PS', Policy Objective 1: A more competitive and intelligent Europe, by promoting innovative and intelligent economic transformation and regional ICT connectivity; Priority 9: Contribution to the STEP Platform: biotechnology and digital technologies, including associated services in the healthcare sector; Specific Objective RSO1.6 Supporting investments that contribute to the objectives of the Strategic Technologies Platform for Europe (STEP platform) mentioned in Article 2 of Regulation (EU) 2024/795 of the European Parliament and of the Council); Action A. Supporting compatible STEP projects submitted within the health project ideas call run by AM PS, Call Code: PS/614/PS_P9/OP1/RSO1.6/PS_P9_RSO1.6_A13.
In the event that funding is not obtained for any reason, the Contracting Authority reserves the right to apply the provisions of Article 212, paragraph (1) lit. c) of Law No. 98 from 2016 regarding public procurement, with subsequent amendments and completions. Tenderers in this procedure understand that the Contracting Authority cannot be held liable for any damage caused in the event that the targeted equipment is not purchased, regardless of whether the Contracting Authority has been notified of the existence of such damage.
Tenderers in this procedure accept the use of the above special conditions/suspensive clause, taking full responsibility for any damages they may suffer in the described situation.

The contracting authority estimates that the necessary funds for signing the public procurement contract for products will be obtained according to the following estimated schedule:
a) Approval of funding by the Ministry of Investments and European Projects for the investment objective: 31.03.2026;
b) Signing of the financing contract: 15.04.2026;
c) Signing of the public procurement contract: 30.04.2026.
