The subject of the order is the delivery of a cellular metabolism analysis system for the Gdańsk Medical University. 2. The subject of the order is detailed in Appendix No. 3 to the SWZ. 3. The contracting authority requires that the offered equipment covered by the subject of the order: a) be brand new, free from any defects and damage, not previously used, and not subject to the rights of third parties, b) be manufactured after January 1, 2024, c) comply with all standards imposed on such goods by Polish law, d) possess a CE declaration of conformity or a CE certificate confirming that the supplied products meet certain standards or technical specifications. The contracting authority accepts an equivalent document issued by an entity based in another member state of the European Economic Area. 4. The contracting authority requires that the Contractor: a) provide a guarantee for the offered equipment described in Appendix No. 3 to the SWZ for a period of at least 12 months from the date of signing the handover protocol by both parties; b) deliver the subject of the order to a place specified by the contracting authority, perform lifting, unpacking, assembly, commissioning of the offered subject of the order, and train the contracting authority's employees on equipment operation. c) present information about the offered equipment in their offer, providing the manufacturer, model, markings, and year of production according to the price-quality form, which constitutes Appendix No. 6 to the SWZ. 5. In preparing the offer, the Contractor should carefully familiarize themselves with the content of all documents comprising the procurement documentation, which should be read along with any modifications and changes made by the contracting authority during the proceedings. 6. Detailed provisions regarding the performance of obligations related to this order are included in the draft contract - Appendix No. 4 to the SWZ. 7. In connection with Article 5k of Council Regulation (EU) 833/2014 of July 31, 2014, concerning restrictive measures in connection with actions by Russia destabilizing the situation in Ukraine (OJ EU L No 229, p. 1) as amended by Council Regulation (EU) 2022/576 of April 8, 2022, regarding the amendment of Regulation (EU) No 833/2014 concerning restrictive measures in connection with actions by Russia destabilizing the situation in Ukraine (OJ EU L No 111, p. 1), the contracting authority informs that it will not award public contracts covered by the directives on public procurement and also covered by Article 10 para. 1, 3, para. 6 letter a)–e), para. 8, 9 and 10, Article 11, 12, 13 and 14 of Directive 2014/23/EU, Article 7 and 8, Article 10 letters b)–f) and letters h)–j) of Directive 2014/24/EU, Article 18, Article 21 letters b)–e) and letters g)–i), Article 29 and 30 of Directive 2014/25/EU and Article 13 letters a)–d), letters f)–h) and letters j) of Directive 2009/81/WE in favor of or with the participation of: - Russian citizens or natural or legal persons, entities or bodies based in Russia; - legal persons, entities or bodies, in which the ownership rights directly or indirectly exceeding 50% belong to an entity referred to in letter a) of this paragraph; - natural or legal persons, entities or bodies acting on behalf of or under the direction of an entity mentioned in letter a) or b) of this paragraph, including subcontractors, suppliers, or entities relied upon in accordance with the directives on public procurement, in cases where more than 10% of the value of the contract is assigned to them. 8. To confirm that none of the circumstances specified in paragraph 7 occurs in relation to the Contractor, a declaration must be attached to the offer - Appendix No. 5 to the SWZ - in electronic form signed with a qualified electronic signature. 9. In the case of joint application for the order by Contractors, the declaration referred to in paragraph 8 above must be submitted by each of the contractors jointly applying for the order.
