1. The subject of the order is the purchase of equipment for pathological diagnostics in 2025 - National Oncology Strategy.
2. A detailed description of the subject of the order is included in attachments no. 1.1 – 1.3 (assortment-price forms) to the bid form.
3. The offered subject of the order must be approved for marketing and use in accordance with applicable law, meet the requirements of Polish and European standards, be marked with the CE mark, and have documents issued by authorized entities required by Polish law (e.g.: CE mark, Declaration of Conformity, necessary certificates, attestations, certificates), in accordance with the act of April 7, 2022, on medical products (i.e. Journal of Laws 2022 item 974). At the same time, the Contractor will be required to present, at any request of the Ordering Party, the appropriate document.
4. Failure to meet the required parameters specified in Attachments no. 1.1-1.3 to the bid form gives the Ordering Party the right to reject the offer.
5. Partial deliveries of individual elements of the subject of the order are not allowed. The delivered subject of the order must be complete, labeled, have the necessary instructions, guarantees, appropriate packaging to ensure proper protection of the equipment's quality against weather factors, damage, etc.
6. The Ordering Party does not allow the submission of variant offers.
7. If the specification indicates brand names or origins in relation to some equipment, the Ordering Party, in accordance with Article 99 para. 5 of the Public Procurement Law, allows the offering of “equivalent products.” All “equivalent products” from specific manufacturers define the minimum qualitative parameters and utility features that goods must meet to fulfill the requirements set by the Ordering Party and constitute only a benchmark for the quality of the subject of the order. Through the clause regarding minimum quality parameter requirements, the Ordering Party understands the requirements for goods contained in publicly available sources, catalogs, manufacturers' websites. Using example names of manufacturers serves only to clarify the Ordering Party's expectations regarding a specific solution. In the case of offering “equivalent products,” the Ordering Party requires the submission of appropriate documents supporting this equipment. These documents will be subject to the Ordering Party's evaluation and will be the basis for the Ordering Party's decision to accept “equivalents” or reject the offer due to their “non-equivalence.”
8. Each Contractor has the right to submit only one offer. The submission of more than one offer by one Contractor or an offer containing alternatives results in the rejection of all offers submitted by that Contractor.
9. Offers will be evaluated based on the criteria described in Chapter XVIII of this SWZ.
10. The Contractor is obliged to deliver the invoice to the Ordering Party no later than December 19, 2025.
