The Bidder participates in economic turnover, i.e., holds authorizations to perform specific activities or tasks covered by the Contract, if laws impose the obligation to hold such authorizations and no liquidation or bankruptcy has been declared against them. The Bidder will confirm fulfillment of this participation condition by submitting a statement in Chapter IA ToR "Offer Form". The Contracting Authority will verify fulfillment of this condition on a "meets/does not meet" basis based on the submitted statement in Chapter IA ToR "Offer Form". The Bidder will confirm fulfillment of this participation condition by submitting a statement included in Chapter IA ToR "Offer Form". The Contracting Authority will verify fulfillment of the exclusion condition on a "meets/does not meet" basis based on the submitted statement in Chapter IA ToR "Offer Form". In case of submitting an Offer as a Consortium, the Contracting Authority requires each Consortium member to meet this condition.
9.2.2. The Bidder has the necessary knowledge and experience to execute the subject of the Contract, in particular in the last 36 months before the Offer submission deadline, or if the business period is shorter – within that period, the Bidder has completed for independent, external clients:
9.2.2.1. Delivery and participation in commissioning of at least 6 energy storage systems, each with a capacity of at least 10 MW, made in LFP technology, in a one-, two- or four-hour system, or delivery and participation in commissioning of at least 1 energy storage system with a capacity of at least 25 MW, made in LFP technology, in a one-, two- or four-hour system.
These implementations must be carried out in the territory of the Republic of Poland or other countries where regulatory, technical, and market conditions for delivery and commissioning of energy storage systems are identical or similar to those in Poland. This requirement does not limit the experience to implementations done only in Poland but allows experience gained in markets with comparable technical standards, safety requirements, and legal frameworks in the electricity and energy storage sector.
The requirement to demonstrate knowledge and experience in deliveries and commissioning of energy storage systems in specified markets and the reference period for experience are necessary to ensure the Bidder has experience acquired under market, technological, and regulatory conditions comparable to those at the place of Contract execution. The indicated markets have similar technical standards, electricity infrastructure development levels, safety requirements and legal frameworks for energy storage, allowing reliable evaluation of the Bidder's ability to properly execute the Contract. The reference period ensures the Bidder's experience is current and reflects the latest technological solutions and applicable industry standards. This limitation is not discriminatory and does not result in unjustified narrowing of competition but stems from the objective need to ensure appropriate quality and safety in Contract execution.
The Bidder will confirm fulfillment of this participation condition by completing and submitting Appendix T03 "List of completed contracts confirming knowledge and experience", including the statement on their proper delivery and commissioning. The Contracting Authority will verify fulfillment of this condition on a "meets/does not meet" basis based on the completed and submitted Appendix T03. The Contracting Authority requires that each person indicated in points 9.3.1.1 and 9.3.1.2 by the Bidder be fully available to the Contracting Authority within the Project, averaging 40 hours per week during the period from delivery to successful commissioning and testing of the installation.
