1. The subject of the contract is the implementation of the investment task entitled "Construction of a gravimetric active sludge selection installation and an aeration control system at the Wastewater Treatment Plant in Rzeszów."
2. The investment consists of the construction and implementation of gravimetric active sludge selection technology and an aeration control system based on NH4-N and NO3-N measurements at the wastewater treatment plant in Rzeszów.
3. A detailed description of the subject of the contract (OPZ) is included in the attached design documentation as well as the technical specifications for the performance and acceptance of construction works.
4. The Contractor may under no circumstances refer to possible omission of certain Works in the measurements provided by the Ordering Party (which have only an auxiliary nature), if these Works are included in the technical documentation. The Contractor is obliged to plan all activities necessary for the execution of the Agreement in accordance with the rules of construction art and applicable regulations, regardless of whether these activities/works are separately listed in any document. It is assumed that the list of planned works on the basis of which remuneration was established has been prepared by the Contractor. Under such circumstances, the Contractor is not entitled to additional remuneration for unpriced Works included in the technical documentation.
5. The Ordering Party does not allow construction works to be carried out using supplies (all materials, construction products, devices, and equipment elements used in the execution of the contract) originating from "third countries that are not parties to international agreements", i.e.:
1) countries other than EU member states,
2) countries other than those parties to the World Trade Organization Government Procurement Agreement or parties to other international agreements guaranteeing reciprocity and equality of access to the public procurement market, of which the European Union is a party;
6. The country of origin of a construction product or device is considered the country where the product was manufactured or where the last significant processing took place. For this purpose, the Contractor shall submit a declaration in the Offer Form.
7. If it is found that the contractor plans to use materials or devices originating from third countries not parties to international agreements, the Ordering Party will reject the offer pursuant to Article 226(1) of the Public Procurement Law as non-compliant with the contract conditions.
8. If it is revealed at the implementation stage that the contractor has used materials or products from third countries not parties to international agreements, the Ordering Party will call on the contractor to immediately replace them with materials compliant with the Terms of Reference, at the contractor’s expense, without extension of the completion deadline.
9. The offered price must include all cost components resulting from the detailed description of the subject of the contract attached to the Terms of Reference and must take into account the requirements and information of the Ordering Party contained in the Terms of Reference, including any explanations provided by the Ordering Party. It must also include everything that is and will be technically necessary for the execution of the task, and contain all costs related to the execution of the contract.
10. In cases where the Ordering Party describes the subject of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Article 101 of the Public Procurement Law, equivalent solutions to those described are permitted.
11. The Ordering Party allows equivalent solutions; however, the Contractor who refers to solutions equivalent to those described is obliged to demonstrate that the supplies, services or construction works offered by him meet the requirements specified by the Ordering Party.
12. The Contractor shall grant warranty and guarantee for the entire subject of the contract for a period not shorter than 24 months from the date of signing the final acceptance protocol of the subject of the contract, under the conditions specified in the draft provisions of the public procurement contract. The warranty and guarantee cover the entire subject including software, PLC controllers, SCADA system, measuring devices, and software updates removing errors.

14. Requirements related to the execution of the contract regarding the employment by the Contractor or subcontractor on the basis of an employment contract of persons performing activities specified by the Ordering Party in the scope of the contract execution are set out in the draft provisions of the public procurement contract.
15. The Contractor is obliged to mark all elements executed under the contract, created objects, infrastructure, as well as all technical and acceptance documentation in accordance with the promotion and labelling rules of projects financed from EU funds. All marking actions will be performed by the Contractor in accordance with:
1) The Visual Identity Book of the "European Funds 2021–2027" brand and the current Applicant and Beneficiary Handbook of the European Funds for 2021–2027 regarding information and promotion,
2) The Visualization Card of the "European Funds for Infrastructure, Climate, Environment 2021–2027" Program (FEnIKS),
3) Patterns of marks and guidelines published on the official program website (www.feniks.gov.pl) and the European Funds portal (www.funduszeeuropejskie.gov.pl).
16. The Contractor is required, as part of the contract, to deliver full configuration documentation, remove service accounts after acceptance, hand over all administrative passwords and undertake not to use unauthorized remote access to the accounts after handing over all administrative passwords.
