Description:
The project involves delivering 12 MAXI class and 2 MIDI class electric buses along with technical service, warranty repairs, and personnel training, as part of the expansion of charging infrastructure in Gorzów Wielkopolski.

The subject of the contract is the execution of the task titled "Purchase of Electric Buses Along with the Expansion of Charging Infrastructure in Gorzów Wielkopolski – Stage IV," which involves the delivery of 12 (twelve) MAXI class electric buses and 2 (two) MIDI class electric buses. Additionally, the Contractor will provide the Purchaser with authorization to perform technical service and warranty repairs for each delivered vehicle and conduct training for the Purchaser's personnel on the operation and maintenance of the buses.
The subject of the contract is being executed in relation to the preparation of the project titled "Purchase of Electric Buses in Gorzów Wielkopolski – Stage IV", for which the Purchaser will apply for funding under the European Funds for Infrastructure, Climate, and Environment 2021–2027 program (FEnIKS), priority FENX.03 Urban Transport, action FENX.03.01 Urban Transport – buses and trolleybuses. The application for funding will be submitted within the competitive call number FENX.03.01-IP.02-001/26, announced by the Centre for EU Transport Projects (CUPT).
The Purchaser will apply the so-called reversed procedure as mentioned in Article 139 Section 1 of the Public Procurement Law, i.e., will first conduct the examination and evaluation of offers and then qualify the entity of the Contractor whose offer received the highest evaluation regarding the absence of grounds for exclusion and fulfillment of participation conditions.
The Purchaser does not foresee the possibility of awarding similar supply contracts, under the basic order, to the current contractor under Article 214 Section 1 Point 8 of the Public Procurement Law.
The Purchaser foresees the possibility of cancelling this procedure based on Article 257 of the Public Procurement Law, if the funds that the Purchaser intended to allocate for financing the entirety or part of the order are not awarded.
The Purchaser foresees the possibility of amending the concluded contract in relation to the content of the selected offer within the scope regulated by Articles 454–455 of the Public Procurement Law and indicated in Section 20 of the Contract Models, constituting Part II of the Terms of Reference.


LOT-0001
Part no. 1: Delivery of 12 MAXI class buses.
The subject of the contract includes:
Part 1 – Delivery of MAXI class electric buses
Delivery of 12 (twelve) brand new, free from physical and legal defects, zero-emission, low-floor urban MAXI class buses with electric drive, approximately 12 meters in length, meeting the requirements set out by the Purchaser in the Terms of Reference and the Description of the Subject of the Order (OPZ).
The offered buses must, in particular:
• meet the requirements specified in the regulations issued under the Act of June 20, 1997, on Road Traffic Law, including the Regulation of the Minister of Infrastructure of December 31, 2002, on technical conditions of vehicles and the scope of their necessary equipment (consolidated text Journal of Laws of 2024, item 502),
• have a valid Vehicle Type Approval Certificate or EU Type-Approval Certificate, issued by the competent authority in accordance with vehicle type approval regulations,
• meet the requirements of UN ECE Regulation No. 107 – uniform provisions concerning the approval of M2 or M3 category vehicles in terms of their general construction, for class I vehicles intended for passenger transport,
• meet the requirements of UN ECE Regulation No. 29 – uniform provisions concerning the approval of vehicles with regard to the protection of persons inside the vehicle's cabin (Official Journal of the EU L of November 5, 2019),
• meet the requirements of UN ECE Regulation No. 66 concerning the strength of the superstructure of large passenger vehicles.

For Part no. 1 of the order - Delivery of MAXI class electric buses.
The Purchaser informs that for part no. 1 of the order, it does not allow contractors from third countries, with which the European Union is not bound by any international agreement guaranteeing reciprocal and equal access to the public procurement market. In the case of submitting an offer by a Contractor from a third country with which the European Union is not bound by any international agreement guaranteeing reciprocal and equal access to the public procurement market, such an offer will be rejected based on Article 226 Section 1 Point 5 of the Public Procurement Law (i.e., due to non-compliance with the order conditions).

Part no. 2: Delivery of 2 MIDI class buses.
Part 2 – Delivery of MIDI class electric buses
Delivery of 2 (two) brand new, free from physical and legal defects, zero-emission urban MIDI class buses (midibuses) with electric drive, approximately 8 meters in length, intended for urban transportation.
The offered buses must, in particular:
• meet the requirements specified in the Regulation of the Minister of Infrastructure of December 31, 2002, on technical conditions of vehicles and the scope of their necessary equipment (consolidated text Journal of Laws of 2024, item 502),
• have a valid Vehicle Type Approval Certificate or EU Type-Approval Certificate,
• meet the requirements of UN ECE Regulation No. 107 concerning M2 or M3 category vehicles intended for passenger transport.

For Part no. 2 of the order – Delivery of MIDI class electric buses
The Purchaser informs that in this public procurement procedure, for part no. 2 of the order, the tendering process is open also to contractors who conduct business and are based or reside in countries that are not EU member states or parties to the WTO Government Procurement Agreement or other international agreements guaranteeing reciprocal and equal access to the public procurement market, to which the European Union is a party. Contractors may also subcontract part of the order to subcontractors from third countries that are not parties to such international agreements (legal basis Article 16b Section 1 Point 1 and 4 of the Public Procurement Law).
