The subject of the contract is the expansion and modernization of the Intelligent Transport System (hereinafter referred to as “ITS”) in Gliwice as part of the project entitled: “Development of sustainable urban transport mobility in Gliwice” aimed at increasing the availability, comfort, and safety of road users as well as supporting low-emission urban transport. The order is carried out in the ‘design and build’ formula and consists of two main stages:
Stage 1 (Design) – preparation of comprehensive project documentation for the ITS system, including the concept for the modernization and expansion of subsystems, traffic organization projects (permanent and temporary), as well as obtaining the required opinions, agreements, and permissions necessary for the execution of the works.
Stage 2 (Implementation) – execution of construction works, delivery and installation of devices, and implementation and launch of the ITS system in accordance with the approved documentation. The order also includes ensuring the integration of all subsystems, operational support, warranty service, and training of the Client’s staff in the operation and use of the expanded system.
A detailed description of the subject of the contract is included in Annex No. 8 to this Specification of Terms of Reference (SWZ) and in the Functional and Utility Program (PFU) – Annex No. 17 to SWZ.
The task titled: “Expansion and modernization of the ITS system in Gliwice” is being implemented under the project entitled: “Development of sustainable urban transport mobility in Gliwice” conducted as part of the European Funds for Silesia 2021-2027 program (European Regional Development Fund) for the Priority: FESL.03.00-European Funds for sustainable mobility for the Activity: FESL.03.02-Sustainable multimodal urban mobility – ZIT.
The required warranty period: 60 months from the date of final acceptance of all works covered by the contract,

Equivalent solutions
1. Acceptance of equivalent solutions:
The Contracting Authority allows the Contractor to apply equivalent solutions concerning materials, devices, software, standards, technical evaluations, technical specifications, or technical reference systems indicated in the SWZ or its attachments (including PFU). These solutions must:
a. be existing, actually implemented, and tested - design or planned solutions are not allowed,
b. ensure the execution of the order in accordance with the requirements of the SWZ and its attachments,
c. guarantee technical, utility, and operational parameters not worse than those specified in the documentation of the order.
2. Definition of an equivalent solution:
By an equivalent solution, the Contracting Authority understands software, devices, materials, and technical solutions that ensure interoperability with the Contracting Authority's systems, possess functions and parameters not lower than those specified in the SWZ and its attachments, including the PFU, and meet all operational and quality requirements specified in the tender documentation.
3. Equivalence criteria and documentation:
In the case of proposing an equivalent solution, the Contractor is required to present documents confirming its equivalency, in particular:
a. references confirming prior implementation,
b. certificates, acceptance protocols or other documents confirming technical parameters, functionality, and compliance with the SWZ requirements.
4. Documents confirming equivalency will be treated as tangible evidence in the sense of Article 107 of the Public Procurement Law. The Contractor is required to submit them with the offer.
5. According to Article 107, paragraph 2 of the Pzp Law, if the Contractor does not submit tangible evidence or the submitted documents are incomplete, the Contracting Authority will call for their submission, supplementation, or correction within a specified deadline, subject to Article 107, paragraph 3 of the Pzp Law.
6. The tangible evidence aims to demonstrate that the offered solution meets the requirements specified in the SWZ, including functionality, technical parameters, and compatibility with the Contracting Authority's systems.
7. An equivalent solution that does not meet the requirements of the SWZ and its attachments will not be accepted by the Contracting Authority. The Contracting Authority reserves the right to evaluate equivalency and refuse to accept a solution that does not meet all required criteria.
The Contracting Authority defines equivalency criteria for the proprietary names used in the PFU in Annex No. 10 to the SWZ.
