4.3. The order has not been divided into parts because the subject of the contract refers to the subject of one industry, i.e. the maintenance of an integrated Area Traffic Control System.

4.4. The Contracting Authority shall allow the Contractor to perform the contract in question with the use of subcontractors, which it is obliged to indicate in Section D in Part II of its own form of the Single European Procurement Document (ESPD).

4.5. The Contracting Authority does not provide for the award of a contract under the right of option.

33.1. Pursuant to Article 95 of the PPL Act, the Contracting Authority requires the Contractor or Subcontractor to employ persons performing the activities indicated by the Ordering Party in the scope of the contract, if the performance of these activities consists in performing work in the manner specified in Article 22 §1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2020, item 1320), i.e. activities of persons performing works related to the maintenance of the IT infrastructure of the Area Traffic Control System during the execution of the order.

The type of activities related to the performance of the contract and the method of verifying the employment of these persons and the ordering party's rights to control the Contractor's compliance with the requirements related to the employment of these persons and sanctions for non-compliance with them are specified in the model contract constituting Annex 5 to the SWZ.
