1. The subject of this order includes:
1) the delivery of 20 units (basic order – guaranteed) of factory new, i.e., produced no earlier than 6 months before the delivery date and not used, identical (of the same type, length, constructed in the same way, according to the same technical documentation, by the same manufacturer) one-section low-floor buses, having documents that constitute the basis for vehicle registration and valid on the date of delivery of a given batch of vehicles, fulfilling the requirements set out in the Regulation of the Minister of Infrastructure of 31 December 2002 on the technical conditions of vehicles and the scope of their necessary equipment (consolidated text Dz.U.2024, item 502, as amended), ready for operation, i.e., primarily adapted for the transport of people in public transport, in accordance with the description of the subject of the order regarding the parameters of buses, specified in Appendix 12A to the SWZ and with the description relating to onboard systems, specified in Appendix 12B to the SWZ;
2) the delivery of 10 units (basic order – guaranteed) of dual charging stations of the plug-in type with a telemetry system, compliant with the description of the subject of the order, specified in Appendix 12C to the SWZ, along with their installation, commissioning and carrying out the acceptance procedure by the Office of Technical Inspection;
3) the delivery of workshop equipment (basic order – guaranteed) valued at 300,000.00 PLN net, containing all necessary specialized tools for ongoing repairs, technical service and diagnostics (including necessary licenses and software in the case of IT systems for a period of 10 years) for the vehicles mentioned in point 1) above. A list of tools will be prepared in consultation with the Ordering Party after the contract is signed, and the tools will be delivered no later than the date of delivery of the first bus;
4) training of the Ordering Party's employees by the Contractor in the scope and according to the principles contained in §2 section 2 of the draft contract (Appendix 11 to the SWZ);
5) providing by the Contractor:
a) operating and repair instructions for the vehicles,
b) a spare parts catalog for the vehicles,
c) specifications of the main assemblies, devices and systems of the buses,
d) specifications of the software supporting the devices or systems of the operational equipment of the buses,
e) software along with licenses allowing free use of all bus functionalities, in the form, quantities and dates specified in §2 section 3 of the draft contract (Appendix 11 to the SWZ);
6) the transfer, along with the chargers:
a) Technical and Operating Documentation (DTR)/operating instructions containing information on: operation, maintenance, any consumables, all documents required by the Office of Technical Inspection for the acceptance of the charger,
b) CE Declaration of Conformity,
c) Warranty Book/Card - 1 copy in paper version and 1 copy in electronic version for each charger (in the case of the invoice issuer not being the Contractor - statements of the Contractor or contracts with the manufacturer confirming cooperation in the sale and service of the manufacturer's products).
2. Detailed descriptions of the subject of the order have been included in Appendices 12A, 12B, and 12C to the SWZ.
3. The Ordering Party reserves that wherever trademarks, patents or origins, sources or specific processes that characterize the products or services provided by a specific Contractor, European standards, technical assessments, approvals, technical specifications, reference technical systems mentioned in Article 101 section 1 point 2) and section 3 of the Pzp have been indicated in the content of the description of the subject of the order - the Ordering Party allows methods, materials, devices, technologies, etc. equivalent to those presented in the description of the subject of the order, understood as produced by any manufacturers while maintaining identical or better technical parameters and usability values and fully compatible with the rest of the devices, provided that they meet the same technical properties and at the stage of execution, they obtain the approval of the Ordering Party. The decisions of the Ordering Party in this regard will be based on the requirements formulated in the contract documents, as well as standards and guidelines. The parameters of the specified standard define the minimal technical, operational, usability, quality and functional conditions to be met by the subject of the order. The specified brands, manufacturer names, trademarks, patents, origins, sources or specific processes that characterize the products serve to establish the desired execution standard and to define the properties, technical requirements of the product, methods, materials, devices, technologies, etc. assumed in the content of the description of the subject of the order.
4. The Ordering Party does not allow the possibility of submitting partial offers - the Contractor must submit an offer covering the entirety of the subject of the order.
5. Co-financing of the realization of this order under the basic order should be provided from funds of the European Funds for Infrastructure, Climate, Environment 20120/2027 within the competition “FENX.03.01 Urban Transport.
6. The order will be co-financed from public funds under the basic order. The Ordering Party may cancel the proceedings for the award of the order if the public funds that the Ordering Party intended to allocate to finance the entirety or part of the order have not been granted to them (Article 257 of the Pzp).
