1. The subject of the contract is the Supply of 5 (five) zero-emission electric buses as part of the investment: Sustainable development of urban public transport in the area of the Puławy Metropolitan Area. 2. The contract is divided into two tasks, the subject of which is:
Task No. 1
Supply of 3 (three) brand new electric MAXI class city buses with technical parameters and equipment specified in the Description of the Subject of the Contract and in accordance with the Contractor's submitted offer.
Task No. 2
Supply of 2 (two) brand new electric MIDI class city buses with technical parameters and equipment specified in the Description of the Subject of the Contract and in accordance with the Contractor's submitted offer.
3. Conducting theoretical and practical training for at least 40 drivers regarding basic operation and use of the bus and techniques of economical driving.
4. Conducting theoretical and practical training for at least 15 technical staff of the Ordering Party on warranty and post-warranty repairs, technical maintenance of buses, and operation and use of the provided diagnostic equipment. 5. Annex No. 3 to the SWZ Technical requirements for the passenger information system devices
Annex No. 4 to the SWZ Technical requirements for monitoring system devices
Annex No. 5 to the SWZ Technical requirements for the ticket machine. 6. The Ordering Party will exclude the Contractor from the procurement procedure if there are grounds specified in:
a) Art. 108 § 1 of the Public Procurement Law,
b) Art. 109 § 1 point 4 of the Public Procurement Law,
c) Art. 7 § 1 of the Act of April 13, 2022, on special solutions concerning counteracting support for aggression against Ukraine and serving the protection of national security (Journal of Laws of 2024, item 507),
d) Art. 5k § 1 of the Regulation of the Council (EU) 2022/576 of April 8, 2022, on the amendment of Regulation (EU) No 833/2014 concerning restrictive measures in connection with actions by Russia destabilizing the situation in Ukraine (Official Journal of the EU L 111 of April 8, 2022, p. 1). A detailed description of the grounds for exclusion is included in section XII of the SWZ. 7. To confirm the absence of grounds for exclusion, the following documents must be submitted:
a) Information from the National Criminal Register in the scope specified in Art. 108 § 1 points 1 and 2 of the statute, issued no earlier than 6 months prior to its submission;
b) Information from the National Criminal Register regarding Art. 108 § 1 point 4 of the statute concerning the lack of a final judgment prohibiting the application for a public procurement as a penalty issued no earlier than 6 months prior to its submission;
c) Contractor's statement, regarding Art. 108 § 1 point 5 of the statute, regarding the lack of affiliation to the same capital group, in the meaning of the Act of February 16, 2007, on the protection of competition and consumers (Journal of Laws of 2024, item 594), with another Contractor who submitted a separate offer in the scope of the given part, or statements regarding membership in the same capital group along with documents or information confirming the submission of the offer in the procedure regardless of another Contractor belonging to the same capital group – annex No. 9 to the SWZ;
d) Extract or information from the National Court Register or from the Central Register and Information on Economic Activity, regarding Art. 109 § 1 point 4 of the statute, issued no earlier than 3 months before its submission, if separate regulations require entry into the register or record;
e) Contractor's statement on the accuracy of the information contained in the declaration referred to in Art. 125 § 1 of the statute regarding the grounds for exclusion indicated in Art. 108 § 1 points 3-6 of the statute and § 109 § 1 point 4 of the statute, and the statement regarding the exclusion grounds from Art. 5k of Regulation 833/2014 and Art. 7 § 1 of the Act on special solutions regarding counteracting support for aggression against Ukraine and serving the protection of national security – annex No. 12 to the SWZ;
