In order to meet the procurement needs, the Purchaser will award a public procurement contract for design, verification, and technical assistance services, as well as the execution of electrification works for the DPWorld Constanța terminal, co-financed through CEF. The selected contractor will be obliged to undertake several activities: -Preparation of the execution technical project in compliance with the provisions of Annex no. 10 to HG907/2016 regarding the stages of preparation and the framework content of the technical-economic documentation related to investment objectives/projects financed from public funds, including detailed geotechnical study according to the Beneficiary's Requirements and the execution details,-Perform technical verification of the project in compliance with the provisions of Hot925/95 for the approval of the Regulation on the verification and technical expertise of projects, the technical expertise of the execution of works and constructions, as well as quality control of the works, with subsequent amendments and completions,-Providing the necessary technical assistance during the execution of the works for creating an electrified infrastructure intended to serve the terminal operated by the Purchaser in Constanța Port, namely the ship supply system at the shore (including determining phases and possible changes of the project made in compliance with relevant legislation, including that in the field of public procurement), -Preparation of a report upon completion of permanent works execution,-Preparation of the “As Built” project for the works aimed at electrifying the CSCT terminal in Port Constanța and ensuring the necessary facilities for using equipment, machinery, and vehicles that use alternative fuels, contributing to the decarbonization of maritime transport and operations carried out in the port. -Regarding the actual execution of the works, this will be implemented by applying the technical solution provided at the level of the documentation drawn up for obtaining AC and will involve the following: Construction of a medium voltage distribution station 20 KV PTC1Prim and implementation of a redundancy loop with PTC1; Electrification of container blocks area A+B: PTC A-B transformation station, duct and cables, bus bar system for 10 blocks; Electrification of container blocks area C+D: PTC C-D transformation station, duct and cables, bus bar system for 8 blocks; Electrification of container blocks area D+E: PTC D-E transformation station, duct and cables, bus bar system for 11 blocks; Creation of the charging hub for electric trucks/equipment: PTC Hub, duct and cables, 5 double charging stations 2 x200 kW; Construction of a transformation station and converters PTC-CI1+2(2x5000 kVA) 20/6.6KV adjacent to PTC1 Prim and connection with 2 cold ironing sockets to be installed on docks 128-130 intended for Portcontainer and RO-PAX Ships and 1 socket in dock 127, installation intended for RO-RO ships; Installation of a PMS dispatching and monitoring system for the Electricity Distribution Network, FDS Fire Detection Systems, access control, intrusion detection, CCTV, connected to application servers within the Workshop building, IT room et1, including the necessary communication network up to the transformation and distribution station PTC1 Prim and further to PTC7. Note! The technical documentation necessary for issuing AC, developed according to Annex no. 9 to HG907/2016, including the OS Project and the documentation for obtaining approvals/agreements, was drawn up and published by the Purchaser in SEAP together with the award documentation. The number of days in which clarifications can be requested before the deadline for submitting offers is 18 days. For requests made within this timeframe, the Purchaser will respond 11 days before the deadline for submitting offers (art161-Law 98/2016)

The Purchaser is conducting this open tender for the awarding of the Contract Agreement for technical design services, technical verification, technical assistance, and electrification works execution for the DP World terminal -Constanța, Romania, co-funded under the Connecting Europe Facility (CEF) Thus, the contract agreement will be conducted in compliance with the General and Specific Conditions for design and execution works contracts, according to Annex no. 2 to HG no. 1/2018, especially regarding the duration, quantity, and cost of services and works, ensuring a proper use of available funds, as well as compliance with quality technical standards and requirements aiming to achieve the decarbonization targets of port activities. Therefore, the contract agreement concluded between the Contractor and the Purchaser will be managed, according to the provisions of HG no. 1/2018, through the Supervisor. Supervision services will be subject to a separate procurement process, which will be conducted in accordance with the Purchaser's own procurement rules. Therefore, the basis for conducting this public procurement contract will primarily be the contract agreement concluded with the Contractor, as well as the general and specific conditions drawn up in compliance with Annex no. 2 to HG no. 1/2018. The subject of the public procurement contract intended to be awarded includes the following: • Technical design services, technical verification, and technical assistance provided by the specialized designers of the Contractor. • Execution of electrification works for the terminal located in the area ZONA MOL II-S PORT CONSTANȚA SUD In concrete terms, the execution of the works included in this Contract Agreement will consist of:  developing an electrical infrastructure for all 29 containers in the terminal, using busbar systems,  creating a HUB for charging the 10 electric tractor heads that will be purchased, consisting of 5 charging stations, which will represent the starting point for operating/using a charging infrastructure,  creating a system for supplying ships at the shore, consisting of installing two cold ironing sockets The estimated total value of the purchase is 153,406,764.07 lei, excluding VAT, of which: • technical design services - 725,871.07 lei, • technical verification services - 51,847.93 lei • technical assistance services, including OSH coordinator - 2,311,636.69 lei, • execution works - 150,317,408.38 lei. Note! As mentioned in Section II.1.4) of these Instructions, the DTAC, including the Site Organization Project, along with the necessary documentation for obtaining permits/agreement for issuing the Construction Authorization, have been drawn up by the Purchaser and the amounts related to them are not included in the estimated value of this award procedure. Moreover, the detailing of the amounts listed on the estimate lines that make up the estimated value is for informative purposes only for bidders, who are not obliged to fit into the respective values, but must respect the total estimate. Clarifications!!  In addition to the amounts that make up the estimated value of the technical design and execution procurement of the electrification works, for establishing the awarding procedure for this contract, consideration will also be given to the amounts found in Subchapter 5.3. Miscellaneous and unforeseen expenses and within Chapter 7 of the general estimate of this investment objective which has been drawn up in compliance with the provisions of HG nr. 907/2016, with subsequent amendments and completions. - Regarding the amounts found within Chapter 7 of the general estimate drawn up at the design phase SF, it is necessary to note the following aspects: - similar to the amounts that are part of the category of “miscellaneous and unforeseen”, those in Chapter 7 will be considered in determining the awarding procedure applicable to this contract, - in this regard, within Subchapter 7.1. of the general estimate are listed the amounts associated with the “budget margin”, namely 25% of the estimated value of this procurement amounting to an estimated 38,351,691.02 lei, - the utilization of the amount related to the budget margin for the contract for design services, technical verification, technical assistance, and execution works necessary in the context of implementing the project activities “Electrification of the DP World Terminal-Constanța, Romania”, co-financed under CEF can only be done in compliance with the provisions of public procurement legislation, - at the same time, the value of the budget margin that can be used during the contract agreement will result from the offer of the economic operator that will be selected at the end of the awarding procedure being calculated by applying the methodology that implies relating the percentage of 25% to the amounts listed on the estimate lines that must be taken into account for determining it, as these amounts are reflected in the future Contractor's offer, - in addition to the budget margin, in Subchapter 7.2 of the general estimate that served as the basis for estimating the value for the services and works whose necessity is described in this reference, is found “the amount related to the implementation reserve for price adjustments”, namely 17,367,863.50 lei, excluding VAT, Therefore, for the purpose of establishing the awarding procedure applicable for this design and execution contract, the following amounts will also be taken into account: • 25,777,255.18 lei, excluding VAT related to the percentage of miscellaneous and unforeseen expenses, • 38,351,691.02 lei, excluding VAT, related to the budget margin,  17,367,863.50 lei, excluding VAT, related to the implementation reserve for adjustment of prices
