The subject of the contract is the execution of construction works as part of the project entitled: Reconstruction and Expansion of the Central Sewage Treatment Plant in Gliwice:
This task is co-financed from the National Reconstruction and Resilience Plan within Investment B3.4.1. Investments for the green transformation of cities.
In relation to this task, the Contracting Authority has submitted an application for its co-financing under the European Funds for Infrastructure, Climate, Environment 2021-2027 (FEnIKS), Part 1) Improvement of energy efficiency (including the installation of RES) in large and medium-sized enterprises, organized by the National Fund for Environmental Protection and Water Management.

2) The detailed scope of works is described in the project documentation, in the granted permissions, notifications, decisions, and agreements related to this subject of the contract and in the specifications for execution and acceptance of construction works. The construction works must be performed in accordance with the project documentation, technical specifications for execution and acceptance of construction works, and other obtained agreements, notifications, decisions, and permits.
3) The detailed scope of the Contractor's obligations has been defined in the project documentation, specifications for execution and acceptance of construction works, and the documentation referred to in point 2) above, in the contract template which constitutes ANNEX 2 to the SWZ and in the Description of the subject of the contract (ANNEX 5 to the SWZ).
4) If the procurement documents refer to certain materials and devices by trademarks or origins, or refer to standards, technical assessments, technical specifications, and systems of technical references, the Contracting Authority, pursuant to Articles 99 and 101 of the Public Procurement Law (Pzp), allows materials or devices (“products”) or equivalent solutions. All “products” from specific manufacturers define the minimum quality parameters and performance characteristics that “products” must meet in order to satisfy the requirements set forth by the Contracting Authority and constitute only a quality benchmark for the subject of the contract. By the provision concerning minimum product quality requirements, the Contracting Authority understands the requirements for goods contained in publicly available sources, catalogs, and manufacturers' websites. Using example names of manufacturers serves only to clarify the level of expectations of the Contracting Authority with respect to a specific solution. Thus, using manufacturer/product names is only illustrative. When describing the subject of the contract, the Contracting Authority, while indicating the designation of a specific manufacturer (supplier) or a specific product, simultaneously allows equivalent products with quality parameters and performance characteristics at least at the level of the specified product, thus accepting any product with the stated parameters or better.
5) The bills of quantities referred to in point 1) above are intended solely to assist the Contractor and do not constitute a description of the subject of the contract. Consequently, considering the lump sum nature of the Contractor’s remuneration, the execution of a greater or lesser number of measured units according to the detailed cost estimate submitted by the Contractor before signing the contract, does not result in an increase or decrease in the Contractor’s remuneration according to its lump sum nature. Before concluding the contract, the Contractor is obliged to submit detailed estimates.
6) Guarantee and warranty term: 60 months of quality guarantee counting from the day of final acceptance and transfer of the subject of the contract to the Contracting Authority. The warranty period for defects is equal to the guarantee period. Detailed conditions regarding quality guarantee and warranty have been specified in § 8 of the contract template - ANNEX 2 to the SWZ).
7) Acting on the basis of Article 100 of the Pzp, the Contracting Authority has prepared the subject of the contract in such a way as to meet the accessibility requirement for persons with special needs to the greatest possible extent, on the principle of equality with other persons, in accordance with universal design principles.
The replacement of the aeration system in biological reactors from surface to fine bubble/bottom aeration guarantees a reduction in the occurrence of bioaerosols in the air, which pose a potential microbiological threat that may activate in individuals with reduced immunity, e.g., after having contracted the COVID virus or after suffering from cancer.
For the needs of persons with visual and hearing disabilities, the replacement of automation visualization has been planned by using appropriate displays of control and monitoring equipment along with sound signaling.
NOTE: The investment will be carried out at an active sewage treatment plant, with the obligation to maintain the quality of treated sewage in accordance with the obtained water law permit. Therefore, works related to the replacement of the aeration system in the biological reactors will be carried out in stages, i.e., sequentially in each of the four biological reactors.
