1. The subject of the contract is the delivery of 4 brand new zero-emission buses – electric, low-floor vehicles, category M3, type MIDI, class II, along with 2 units of dual-position mobile chargers.
2. The scope of the order includes:
1) Delivery of 4 brand new, low-floor buses of type MIDI class II, intended for passenger transport and suburban services in public collective transport;
2) Delivery of 2 units of dual-position mobile chargers for charging the main batteries in the bus.
3) Delivery of software and licenses for central management software, Dispatcher Application, software for diagnosing pneumatic systems in the Vehicle, software for diagnosing electronic systems in the bus, software for a system preventing wheel locking during emergency braking, and electronically controlled braking system with diagnostic software.
4) Conduct training on the operation of buses and chargers, as well as on proper ongoing maintenance and operation of the Dispatcher Application.
3. The vehicles must meet technical conditions and requirements ensuring traffic safety, safety of transporting persons and goods, and environmental protection in accordance with the Act of June 20, 1997 - Road Traffic Law (Journal of Laws of 2024, item 1251 as amended) and appropriate implementing regulations.
4. Zero-emission vehicles are defined in Article 2 point 1 of the Act of January 11, 2018 on electromobility and alternative fuels (Journal of Laws of 2024, item 1289 as amended). According to the aforementioned Act, a zero-emission bus means a bus as defined in Article 2 point 41 of the Act of June 20, 1997 - Road Traffic Law (Journal of Laws of 2024, item 1251 as amended) and a trolleybus within the meaning of Article 2 point 83 of that Act, utilizing electric energy for propulsion, including energy generated from hydrogen in the installed fuel cells, or exclusively an engine whose operating cycle does not lead to the emission of greenhouse gases or other substances covered by the greenhouse gas emissions management system and other substances referred to in the Act of July 17, 2009 on the management system for greenhouse gas emissions and other substances (Journal of Laws of 2022, item 673 as amended).
5. The vehicles must meet the requirements of the relevant Polish standards PN, EN standards, and Regulations of the United Nations Economic Commission, specified in the OPZ, necessary for admission to movement and registration of Vehicles within Poland.
6. The vehicles must have a valid, unconditional vehicle type approval certificate or a type approval certificate EC or another equivalent document allowing movement and registration of the Vehicle within Poland.
7. The offered subject of the order and its components must be covered by a warranty provided by the Contractor for periods calculated from the day following the final protocol acceptance of the given Vehicle, subject to point 8 according to the following listing:
a) complete vehicle - min. 3 years, (Note: bid evaluation criterion),
b) durability of the construction and bodywork of the Vehicle - 15 years,
c) perforation caused by corrosion of the external body panels and the chassis structure without the need for additional maintenance during operation - 15 years,
d) external paint coatings - 5 years,
e) elements of the passenger information systems, video monitoring - 3 years,
f) elements of additional equipment - 3 years,
g) fire detection and suppression system - 10 years,
h) main batteries - 10 years,
i) charger - 10 years.
8. The place of delivery of the buses and chargers will be within the municipality of Ziębice – the exact location will be indicated by the Contracting Authority within 3 days from the notification of readiness for final acceptance. Delivery according to Incoterms 2020: Delivery Duty Paid “delivered, customs paid”.
9. The technical and operational requirements for the buses and chargers are presented in the Detailed Description of the Subject of the Order, and the detailed description of the way the Order is carried out is specified in the Draft Provisions of the Contract.
10. The Detailed Description of the Subject of the Order, including technical and operational requirements for the Vehicles, has been included in Appendix No. 9 to the SWZ.
