1. The subject of the contract is the delivery and installation of photovoltaic systems and solar collectors under the design and build mode. 2. The contract has been divided into two parts:
Part I – Delivery and installation of photovoltaics and energy storage in a design and build formula
Part II – Delivery and installation of solar collectors in a design and build formula
The contractor may submit an offer for all or for the selected part of the order. The contracting authority does not limit the number of parts for which the contract may be awarded to the same contractor.
3. The detailed scope of the subject of the contract and the conditions for implementing the investment (for both parts of the contract) are specified, apart from the Terms of Reference (SWZ), in the following documents:
a) Functional-Utility Program “PFU” (attachment no. 12 to SWZ);
b) Draft provisions of the contract (attachments no. 2a and 2b to SWZ);
c) Contractor's offer along with attachments,
d) Explanations to the SWZ (if applicable).
4. The contracting authority requires the contractor to provide a quality warranty and liability for defects for the completed subject of the contract for a minimum period of 72 months (for parts I and II). NOTE: The warranty period for quality and liability for defects for the completed subject of the contract constitutes a criterion for evaluating offers (for parts I and II). At the same time, the contracting authority requires warranty periods for the installed devices, systems in accordance with the description contained in the PFU. If the warranty period provided by the manufacturer of the device or installation is longer than the periods indicated in the PFU, the manufacturer's warranty period applies.
5. The contracting authority does not foresee awarding contracts based on Art. 214 sec. 1 points 7 and 8 of the Public Procurement Law (Pzp). 6. The contracting authority does not foresee a mandatory site visit.
7. SUBJECTIVE MEANS OF EVIDENCE
7.1. To confirm that the offered subject of the contract meets the requirements, features, or criteria specified by the contracting authority, which are necessary to conduct the proceedings, the contracting authority requires the submission of subjective means of evidence along with the offer.
7.2. The contracting authority requires the submission of the following subjective means of evidence along with the offer (for parts I and II):
- technical specification of the offered subject of the contract (filled in by the contractor according to the template constituting attachment no. 13 to SWZ for part I and attachment no. 14 to SWZ for part II),
- attachment of catalog cards, manufacturer declarations, certificates, and other documents confirming compliance with the minimum requirements (pertains to photovoltaic modules, inverters, and energy storage for part I of the contract and solar collectors for part II).
7.3. If the contractor fails to submit the subjective means of evidence or the submitted means are incomplete, the contracting authority will request that the contractor submit or complete them within the designated period.
8. The subject of the contract will be executed within the framework of funding from the Regional European Funds Program for Greater Poland 2021-2027, Priority 10 Fair Transformation of Eastern Greater Poland, Action 10.6 Bringing Eastern Greater Poland closer to achieving climate neutrality | European Funds for Greater Poland.
9. The contracting authority will use the provisions of Art. 139 sec. 1 of the Pzp, i.e.: The contracting authority will first conduct an examination and evaluation of offers, and then qualify the contractor whose offer has been rated the highest in terms of the absence of exclusion grounds and compliance with the participation conditions in the proceedings.
10. The contracting authority, using the provisions of Art. 257 Pzp, informs that it may annul the proceedings for awarding the contract if the public funds that the contracting authority intended to allocate for the financing of the whole or part of the order have not been granted to it.
11. (as appropriate for Parts I and II) The contracting authority requires that the contractor whose offer is selected as the most favorable, before concluding the contract, provides a security for due performance of the contract in the amount of 3% of the total (gross) price stated in the offer for the execution of the entire subject of the contract. The security serves to cover claims resulting from non-performance or improper performance of the contract. Detailed provisions are included in chapter XXIII of the SWZ.

Part I – Delivery and installation of photovoltaics and energy storage in a design and build formula.
The subject of Part I: delivery and installation of photovoltaics and energy storage in a design and build formula:
1) The entirety of the task, i.e., the factual scope carried out in the territory of the Kawęczyn commune, includes works that will be carried out in a design and build formula, related to:
- Preparation of comprehensive, interdisciplinary project documentation, covering all works defined in the functional-utility program regarding the delivery and installation of photovoltaic systems and photovoltaic installations with energy storage for residential buildings and public utility buildings, preparation of as-built documentation, obtaining the required opinions, decisions, agreements, permits, and notifications required by law,
- Execution of works defined in the functional-utility program regarding the delivery and installation of photovoltaic systems and installations with energy storage for residential buildings and public utility buildings, commissioning of the installation, training of users, exercising authorial supervision over the implementation of the investment.
Note:
1. The contracting authority requires the execution of the subject of the contract in two stages, i.e.:
Stage I covering residential buildings and properties of residents
Stage II covering public utility buildings.
2. The contracting authority informs that before commencing installation works, the project documentation will require approval respectively by the resident, the contracting authority, and the Marshal's Office of the Greater Poland Voivodeship. Approval of the documentation does not absolve the contractor from liability for defects and flaws in the subject of the contract.
2) The contractor will be obliged to perform all works, services, and inspections that will ensure the validity of the warranty for individual devices/elements of the installation – in accordance with the guidelines provided by the respective manufacturer of the devices/elements of the installation in this regard – throughout the entire warranty period, in accordance with the offer submitted during the proceedings.
3) The devices and construction products used by the contractor must:
- be brand new, not older than 2025,
- have an operating and usage manual in Polish,
- have a written warranty from the manufacturer or contractor regarding quality,
- be placed on the commercial market in accordance with the provisions of the Act of April 13, 2016 on conformity assessment systems and market supervision (Journal of Laws of 2025, item 568),
- have a declaration of conformity with the provisions specified in the harmonized legislation of the community and the provisions of Regulation (EU) No. 305/2011 of the European Parliament and of the Council of March 9, 2011, laying down harmonized conditions for placing construction products on the market and repealing Council Directive 89/106/EEC - marked “CE” or have a national declaration of performance issued under the provisions of the Act of April 16, 2004 on construction products (Journal of Laws of 2021, item 1213) - marked “B”,
- other requirements regarding photovoltaic installations and energy storage have been specified in the PFU.
3. In order to execute the task, the contractor is obliged to deliver at its own cost and expense the materials, machines, and devices necessary for the execution, and to perform all accompanying works, tasks, and actions necessary for the execution of the order. The delivered materials must meet the requirements of products permitted for sale and use in construction. All materials used must be new, meet current standards or technical approvals, and possess documents such as: test certificate, certificate of conformity.
4. The contractor is obliged to comply with the applicable health and safety and fire protection regulations and secure the site of the works and operations for the entire period of their implementation, until the final acceptance of the works.
5. The detailed scope of the subject of the contract and the conditions for the implementation of the investment (for both parts of the contract) are specified, apart from the SWZ, in the following documents:
a) Functional-Utility Program “PFU” (attachment no. 12 to SWZ);
b) Draft provisions of the contract (attachments no. 2a and 2b to SWZ);
c) Contractor's offer along with attachments,
d) Explanations to the SWZ (if applicable).
6. NOTE: All contents indicated in the Functional-Utility Program constitute the starting and assisting material for the contractor to prepare their own designs for the execution of individual tasks, which together create the subject of the contract. In the case of discrepancies between the solutions presented by the contracting authority and those developed by the contractor, the contractor will not claim any rights to additional remuneration.
7. The contracting authority requires the contractor to provide a quality warranty and liability for defects for the completed subject of the contract for a minimum period of 72 months (for parts I and II).
