The subject of the contract is the delivery of a range of products defined in accordance with Article 2 points 12-13 of the regulation of the European Parliament and of the Council (EU) 2019/881 of April 17, 2019, concerning ENISA (the EU Agency for Cybersecurity) and cybersecurity certification regarding information and communication technologies and repealing Regulation (EU) No 526/2013 (Cybersecurity Act):
• ICT product means an element or group of elements of networks or IT systems,
• ICT service means a service that is fully or mainly based on the transmission, storage, retrieval, or processing of information via networks and IT systems, whereas
• ICT process means a set of activities performed to design, develop, deliver, or maintain ICT products or ICT services.
The subject of the contract specifically includes the integration between the systems functioning in the unit and the Intelligent Services Platform (PUI) of the e-Health Center. The objective of the task is to integrate and exchange data with the intelligent services platform (PUI) developed by the e-Health Center in the field of AI, supporting the process of diagnostic and therapeutic decision-making by doctors.
The subject of the contract includes the connection (expansion) of the PACS system with a module or functionalities that enable connection (integration) to the central repository of medical data at the e-Health Center in the field of AI (PUI), meeting:
a) the requirements specified in the competition rules (Annex No. 4 Scope of implementation of the project for selection (competitive mode – I recruitment – Investment D.1.1.2)) in respect of chapter no. 4;
b) the requirements of CeZ for PUI according to the current versions of documentation available at https://ezdrowie.gov.pl/portal/home/dla-dostawcow/platforma-uslug-inteligentych
As equivalent solutions for connecting the PACS system to PUI, the contracting authority allows the connection (expansion) of the RIS system enabling connection (integration) to the central repository of medical data at the e-Health Center in the field of AI (PUI).
The software provider subject to integration with the Intelligent Services Platform in the implementation of Digital Diagnostics Services is tasked with:
a) connecting the implemented solution to PUI,
b) conducting tests indicated in the current version of the documentation available at https://ezdrowie.gov.pl/portal/home/dla-dostawcow/platforma-uslug-inteligentych,
c) confirming the carrying out of the process of receiving a document issued by CeZ, confirming the sending of at least one imaging study to PUI,
d) the implemented solution must allow the contracting authority to:
• obtain technical capability to automatically transmit imaging data from diagnostic devices to the Intelligent Services Platform via the implemented PACS/RIS solutions and send this data according to integration guidelines;
• integrate with the Intelligent Services Platform in such a way that the contracting authority can use PUI services without switching or logging into another system,
• integrate with the Intelligent Services Platform so that the contracting authority can provide feedback on the quality of the intelligent service functioning.
The software being delivered must be brand new, complete, and unused. The subject of the order must be free from legal and physical defects. The contracting authority requires that the offered subject of the order meets the requirements specified by applicable Polish law and EU law, has been admitted to circulation, and possesses legally valid documents confirming its admission for use in the EU, as well as meet other requirements (standards, parameters) specified by the contracting authority in the Description of the Subject of the Order.
A detailed description of the subject of the order and quantities is specified in Annex No. 2 to the SWZ.
Information regarding the principles of delivery execution, warranty, and remuneration is included in Annex No. 3 to the SWZ - draft provisions of the contract regarding the public procurement.
The subject of the order must meet the requirements of the principle of “do no significant harm” (DNSH), in accordance with Article 17 of Regulation (EU) 2020/852 of June 18, 2020. This principle applies due to the financing of the order under the National Reconstruction and Resilience Plan (KPO).
The DNSH principle means that at no stage of the contract execution – from production, through delivery, use, to potential disposal – may there be serious harm to the EU's environmental objectives, namely:
1. Climate change mitigation,
2. Adaptation to climate change,
3. Sustainable management of water and marine resources,
4. Circular economy (CE),
5. Pollution prevention and control,
6. Protection of biodiversity and ecosystems.
According to Article 257 of the Public Procurement Law, the contracting authority envisages the possibility of canceling the proceedings if the public funds intended for financing all or part of the contract are not granted to it.
