The project involves comprehensive construction and installation of a 950 kWp photovoltaic system with 200 kWh energy storage, modernization of medium voltage electrical switchgear, and the implementation of measurement and monitoring systems at a facility in Krynica-Zdrój.
Execution of construction works under the design and build formula The subject of the contract is to perform construction works under the "design and build" formula, including the comprehensive installation of a 950 kWp photovoltaic system ensuring an expected annual energy production of at least 972,000.00 kWh/year with a 200 kWh energy storage and modernization of the medium voltage (MV) electrical switchgear along with the replacement of devices and installations used for energy generation and necessary materials, design and reconstruction of the MV field and measurement, monitoring, and control systems with measuring devices being an integral part of the photovoltaic system for the facility at Wiejska 48 Street in Krynica-Zdrój. The subject of the contract includes the following components: • Photovoltaic installation – 1 set, • Energy storage – 1 unit, • Measurement systems – 1 set, • Modernization of the MV electrical switchgear (replacement of devices and installations used for energy generation) – 1 service. According to the energy audit of the thermo-modernization project to increase energy efficiency, it is necessary to install photovoltaic panels with an installed capacity of 950 kWp and an expected annual energy production of at least 972,000.00 kWh/year as well as an energy storage with a capacity of 200 kWh. The photovoltaic installation will contribute to the production of clean electrical energy, simultaneously powering the building's heating system and supporting part of the technological process, thereby reducing dependence on external energy supplies and lowering operational costs. The measurement, monitoring, and control system with measuring devices is an integral part of the photovoltaic installation. The system comprises analyzers, meters, PME monitoring system, and a server. Modernization of the MV electrical switchgear (replacement of devices and installations used for energy generation) includes the service of replacing devices and installations used for electric energy generation along with necessary materials (design and reconstruction of the MV field, telemetry). The subject of the contract includes: 1) Preparation of design documentation for the 950 kWp photovoltaic installation with an expected annual energy production of at least 972,000.00 kWh/year, a 200 kWh energy storage, and measurement, monitoring, and control systems being an integral part of the photovoltaic installation, as well as modernization of the MV electrical switchgear (replacement of devices and installations used for energy generation) along with obtaining a valid building permit. 2) Execution of construction works for the 950 kWp photovoltaic installation with an expected annual energy production of minimum 972,000.00 kWh/year with a 200 kWh energy storage together with the measurement system, modernization of the current installation, and modernization of the MV switchgear with obtaining the final occupancy permit. 3) The contractor shall provide a quality guarantee for the subject of the contract and deliver to the contracting authority appropriate warranty documents as required. The warranty period is counted from the day the contracting authority signs the final acceptance protocol of the subject of the contract. No provisions of this Request for Proposal, its attachments, the contractor's offer, or attachments to the contractor's offer may exclude, limit, or modify to the detriment of the contracting authority the contractor's liability under the warranty for defects arising from general provisions. 4) The contracting authority shall bear the administrative costs related to the execution of the subject of the contract. 5) Execution of the subject of the contract in accordance with the technical requirements contained in the Attachments to this Request for Proposal: - Attachment No. 9 – ENERGY AUDIT CARD OF THE THERMO-MODERNIZATION PROJECT - Attachment No. 10 – Functional and Utility Program (PFU) for the photovoltaic installation with energy storage, modernization of the MV station and measurement, monitoring and control systems defining the contracting authority’s requirements, execution standard, and technical parameters of the installation - Attachment No. 11 – Connection conditions for the photovoltaic installation issued by TAURON Dystrybucja S.A. - Attachment No. 12 – Basic geodetic map of the area covered by the study - Attachment No. 13 – Roof expert opinion for the hall building and in accordance with the rules of construction art, technical knowledge, applicable regulations and standards.
If in the content of the Request for Proposal or its attachments referencing the subject of the contract a manufacturer’s name, trademark, patent, origin, or solution indicating a specific manufacturer with respect to certain materials, construction products, devices, etc. is indicated, the contracting authority requires treating such indication as exemplary and allows the use of equivalent materials, construction products, devices, solutions, etc. with parameters not worse than those indicated. This applies to all elements of the description of the subject of the contract whereby trademarks, patents, origin, source or a special process characterizing products or services supplied by a specific contractor are mentioned. In all such cases, the contracting authority permits the offer of equivalent materials, devices, construction products, systems, and technologies. Thus, the contracting authority allows inclusion in the offer and subsequent use of materials, devices, construction products, systems, and technologies equivalent to those given in the Request for Proposal, provided parameters not worse than those specified in the documentation attached to this Request for Proposal are guaranteed.
The contracting authority specifies the required installed capacity of the photovoltaic installation at 950 kWp with a positive tolerance of up to 0.21%, corresponding to a maximum capacity of 952 kWp. The contracting authority sets the nominal capacity for the energy storage at 200 kWh with a positive tolerance of up to 5%, corresponding to a maximum capacity of 210 kWh. Due to the accepted positive tolerances resulting from substantive installation conditions, the permissible parameter ranges are respectively: - photovoltaic installation: min. 950.0 kWp - max. 952.0 kWp, - energy storage: min. 200 kWh - max. 210 kWh. The introduction of the above tolerance results from the availability of devices produced in specific series of power and capacity, and the need to maintain optimal design and technological solutions. The allowed tolerance does not change the functionality of the subject of the contract, does not affect achieving the assumed technical and ecological effects, and is aimed at ensuring competitiveness of the procedure by enabling the use of devices from various manufacturers. The offered subject of the order must fall within the above ranges, which means that offers proposing a photovoltaic installation with a power below 950 kWp or above 952 kWp and an energy storage capacity below 200 kWh or above 210 kWh will be considered non-compliant with the contracting authority's requirements and will be rejected. The bidder is obliged to attach to the offer a specification containing the basic parameters of the offered subject of the order according to Attachment No. 1A to this Request for Proposal. The assessment of compliance will be made based on the submitted statement on a meet/do not meet basis.
Construction works will be carried out in an operational facility and must not disrupt the functioning process of the facility. Securing the construction site and conducting all construction work in a manner permitting continuous operation of the facility must be planned. The contracting authority assumes that works will be carried out according to a work schedule agreed between the contracting authority and the contractor. It is explained that works in other scopes may take place in the facility simultaneously.
Documentation constituting Attachments No. 9, 10, 11, 12, 13 as well as the model construction works contract – Attachment No. 14 will be provided to the bidder, i.e., made available electronically after signing and delivering the Confidentiality Agreement constituting Attachment No. 8 to this inquiry. The Confidentiality Agreement should be delivered in original to the contracting authority’s office or as a document bearing an electronic qualified signature sent by email to: artur.rekas@inex.pl. After receiving the Confidentiality Agreement, the contracting authority will send the documentation and contract template electronically within 3 business days to the email address indicated in the Confidentiality Agreement.
The contracting authority does not require the bidder to conduct a site visit. If the bidder intends to conduct a site visit before submitting the offer, it is possible after prior arrangement of the date with the contracting authority. The contracting authority allows the following hours for site visits: on working days from 10:00 to 14:00. The appointment for a site visit must be made in writing by sending a request to the email address: artur.rekas@inex.pl. The condition for conducting the site visit is the signing and delivery of the Confidentiality Agreement constituting Attachment No. 8 to this inquiry.

Participation conditions: - Authorization to perform a specified activity or action: The contractor shall possess the required authorizations to perform the activities or actions covered by the subject of the contract, if regulations impose an obligation to hold such authorizations; The contractor is obliged to attach a relevant excerpt from the National Court Register (KRS) or CEIDG to the offer.
Assessment of compliance will be made on a meet/not meet basis based on the statement submitted by the bidder and required documents. Details in Request for Proposal No. 01/0886/2026/K - Knowledge and experience: The contractor must have the necessary knowledge and experience to carry out the works covered by the subject of the contract. The bidder must demonstrate knowledge and experience indicated in the points a) and b) below. a) The bidder must demonstrate that within the last 5 years prior to the bid submission date, or if the business operates shorter than 5 years – within that period, they have completed correctly at least three tasks involving preparation of design documentation for photovoltaic installations with capacity not less than 600 kWp with energy storage of not less than 100 kWh, or photovoltaic installation projects with energy storage with design works value not less than PLN 100,000.00 net each [design works], confirmed by e.g. references, acceptance protocols indicating the nature and completion dates of the orders (or a statement by the contractor if, for a justified objective reason, the contractor is unable to obtain such documents). The contractor must attach a list of completed tasks according to the template in Attachment No. 5 to this Request for Proposal and attach required documents confirming knowledge and experience, e.g. references. The contracting authority allows combining design works in cases where separate design documentation was prepared for photovoltaic installations and energy storage to meet the condition. The contractor may use resources of other entities. In such a case, the offer shall include a written statement from the third party on providing the necessary resources. b) The bidder must demonstrate that within the last 5 years prior to the bid submission date, or if the business operates shorter than 5 years – within that period, they have completed and properly finished at least three tasks of nature identical or similar to the subject of the contract i.e. Photovoltaic installations with a capacity of not less than 600 kWp with an energy storage capacity of at least 100 kWh or with a contract value of not less than PLN 2,000,000.00 (two million zlotys) net each, which will be confirmed, for example, by references, acceptance protocols indicating the subject of the contract and the date of completion (or a statement from the Contractor if, for an objectively justified reason, the Contractor is unable to obtain these documents). The Contractor is obliged to attach to the offer a list of completed tasks according to the template constituting Annex No. 5 to this request for proposals and to attach the required documents confirming the knowledge and experience held, e.g., references. The Contracting Authority allows combining construction works where photovoltaic installations and energy storage were carried out separately to demonstrate compliance with the condition. When fulfilling the [construction works] condition, the Contractor may use the resources of other entities. In such a case, a written statement from the third party about making the necessary resources available must be attached to the offer, indicating the scope of works delegated to the third party. Details in Request for Proposals No. 01/0886/2026/K - Economic and Financial Situation: An economic and financial situation ensuring proper execution of the full scope of the contract is recognized when the Contractor is not in bankruptcy or liquidation, no bankruptcy, arrangement or restructuring proceedings have been initiated, and the Contractor has good financial standing. a) To confirm the fulfillment of the above condition, the Bidder is obliged to submit with the offer a statement on the economic and financial situation, according to Annex No. 5 to this request for proposals, and a statement on having liability insurance for conducted business activities (business liability insurance policy). To confirm participation in the procedure, the Contractor must possess a paid business liability insurance policy covering the subject of the contract with a minimum insurance sum of PLN 3,000,000.00 (three million zlotys), covering design work and construction works. The Bidder must submit a copy of the paid business liability insurance policy with the offer. The Contracting Authority accepts for confirmation of the condition the submission of separate insurance policies for construction works with a sum insured of at least PLN 2,900,000.00 (two million nine hundred thousand zlotys) and for design work with a sum insured of at least PLN 100,000.00 (one hundred thousand zlotys). When meeting the condition in the scope of having business liability insurance, the Contractor may use the resources of other entities by submitting separate paid insurance policies for construction works and design works in the required amounts. In this case, a written statement of the third party about making the necessary resources available with an indication of the scope of design works or construction works to be delegated to the third party must be attached to the offer.
Additionally, the Bidder is obliged to submit all the following documents with the offer: 1) a current certificate from the appropriate Tax Office (or another tax authority responsible for monitoring obligations to the State Treasury) confirming that the Contractor has no tax arrears or a certificate that legal exemption, deferral, installments or suspension of execution of the decision of the competent authority has been obtained, issued not earlier than 30 days before the deadline for submitting offers; 2) a current certificate from the Social Insurance Institution branch (or another authority responsible for monitoring timely payment of employee contributions) confirming that the Contractor has no arrears in payments of contributions for health and social insurance or a certificate that legal exemption, deferral, installments or suspension of execution of the decision of the competent authority has been obtained, issued not earlier than 30 days before the deadline for submitting offers.

Details in Request for Proposals No. 01/0886/2026/K - Additional Participation Conditions: 1. The condition of participation in the procedure is the submission of a bid bond of PLN 100,000.00 (one hundred thousand zlotys) before the deadline for submitting offers. The bid bond may be submitted in the form of: - cash to the Contracting Authority's bank account no. 16 1090 1665 0000 0001 2064 1057 held at Erste Bank Polska; - bank guarantee; - insurance guarantee; - bank sureties or sureties of a cooperative savings and credit union, with the duty of the credit union always being a monetary obligation; - sureties granted by entities referred to in art. 6b para. 5 point 2 of the Act of November 9, 2000, on the establishment of the Polish Agency for Enterprise Development. An appropriate document confirming the submission of the bid bond must be attached to the offer. The assessment of meeting the condition will be made on a meet/not meet basis based on the document submitted by the Bidder. 2. All materials, building products, devices, and other parts/elements comprising the subject of the contract must be brand new. A new fixed asset is one that is manufactured (produced) by a factory (industrial plant), which was not used in any form before purchase. This means they should come directly from the manufacturer or from intermediaries involved in their trade. Brand new fixed assets may also be considered those acquired from other sellers if they have not been previously used (operated), have never been recorded in the fixed assets register, and have not been subject to depreciation. The statement regarding the Contractor's commitment to supply brand new materials/construction products/devices/fixed assets constitutes Annex No. 2 to this request for proposal. The condition fulfillment assessment will be made on a pass/fail basis based on the statement submitted by the Bidder. 3. Entities personally or financially related to the Contracting Authority may not participate in the procedure. Capital or personal ties mean mutual relations between the beneficiary or persons authorized to incur obligations on behalf of the beneficiary or persons performing activities related to the preparation and conduct of the Contractor selection procedure on behalf of the beneficiary and the Contractor, in particular: a) participation in a company as a partner of a civil or personal company, holding at least 10% shares or stocks (unless a lower threshold results from legal provisions), serving as a member of the supervisory or management body, proxy, attorney, b) being in a marital relationship, kinship or affinity in a direct line, kinship or affinity in a collateral line up to the second degree, or related through adoption, guardianship or custody, or living in a common household with the contractor, its legal representative or members of the managing or supervisory bodies of contractors applying for the contract, c) having such legal or factual relations with the contractor that raise justified doubts about their impartiality or independence in connection with the award procedure. The Contractor is obliged to attach a statement according to Annex No. 3 to this request for proposal. The condition fulfillment will be assessed on a pass/fail basis based on the statement submitted by the Bidder. 4. The contract may not be awarded to entities indicated in Art. 7 para. 1 of the Act of April 13, 2022, on special solutions to counteract supporting aggression against Ukraine and protecting national security (Journal of Laws, item 835, 1713). The Bidder is required to attach a declaration of absence of the aforementioned ties according to the template constituting Annex No. 4 to this request for proposal. The assessment of condition fulfillment will be made on a pass/fail basis based on the statement submitted by the Bidder. 5. The Contractor is required to submit with the offer a Commitment to segregate waste in accordance with applicable regulations during order execution constituting Annex No. 6 to this request for proposal. The condition fulfillment will be assessed on a pass/fail basis based on the statement submitted by the Bidder. 6. The Contractor is obliged to attach to the offer a statement regarding the performance of information obligations based on Articles 13 and 14 of the Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, according to the template constituting Annex No. 7 to this request for proposal. The condition fulfillment will be assessed on a pass/fail basis based on the statement submitted by the Bidder.

The offer must be prepared in accordance with the Offer Form constituting Annex No. 1 to this request for proposal. 3. The submitted offer should include all costs associated with order execution, in accordance with the requirements of request for proposal No. 01/0886/2026/K. 4. The offer price should include net and gross price with two decimal places. The offer price shall be expressed in PLN or foreign currency. The Contractor is obliged to provide the currency code of the offer price. If the price is expressed in foreign currency, it will be converted into PLN at the average NBP exchange rate applicable on the last day of the offer submission deadline. The price of the inquiry subject – the price offered by the Contractor is a lump sum price and includes all expenses related to the execution of the order and all public law charges (in particular indirect and direct taxes, related to mandatory insurances) and other costs incurred by the Contractor to properly and in accordance with this inquiry’s requirements and applicable law realize the order. The price will not be increased for any reason unless explicitly stipulated otherwise by the Contracting Authority in this Inquiry, the contract for order performance, or in writing during order implementation.

The offer must include: 1) Proof of bid bond payment; 2) Statement – basic parameters of the offered subject of the order (Annex 1A); 3) Contractor's commitment to deliver brand new fixed assets (Annex 2); 4) Declaration of lack of personal or capital ties (Annex 3); 5) Declaration pursuant to Art.7 para. 1 of the Act of April 13, 2022, on special solutions to counteract supporting aggression against Ukraine and protecting national security (Journal of Laws, item 835, 1713) (Annex 4); 6) Declaration of fulfillment of requirements regarding financial situation, experience, and technical potential (Annex 5) along with required attachments: a) Extract from KRS or CEIDG, b) Certificate of no tax arrears (current certificate from the competent Tax Office), c) Certificate of no arrears in health and social insurance contributions (current certificate from the appropriate Social Insurance Institution), d) Paid business liability insurance policy/policies, accompanied by proof of premium payment, e) References indicated in point 5.6.1.2) or other documents issued by the entity for which the tasks were performed, confirming whether they were executed in accordance with the law, the contract, and properly completed (or Contractor’s statement if for justified objective reasons the Contractor is unable to obtain these documents) – relating appropriately to design and construction works, f) Documents indicated in point 5.7.1. confirming possession of entitlements: building licenses and certificates confirming membership of the appropriate construction chamber, UDT certificates for photovoltaic installation installers, SEP qualifications in group G1 – Electrical (operational E and supervisory D qualifications), g) Statements from third parties providing resources – if applicable; 7) Contractor's commitment to segregate waste during order execution (Annex 6); 8) GDPR clause (Annex 7); and any other documents and statements arising from this inquiry for proposal.
Offers, statements, and documents required by the Contracting Authority and prepared by the Bidder must be signed by persons authorized to represent the Bidder and incur obligations corresponding to the value of this contract, i.e., persons listed in the registration document (records) or authorized by an appropriate document – in such case, the original power of attorney (or a notarized copy/notarial excerpt) must be attached to the offer. An offer signed by an unauthorized person will be considered invalid.
It is clarified that the procurement procedure is conducted in Polish. This requirement relates to the regulation of the Act of October 7, 1999, on the Polish language, which sets the principle of using Polish by entities performing public tasks in the territory of the Republic of Poland. Article 11 of the Polish Language Act stipulates that Articles 5-10 do not apply to, among others, proper names, commonly used scientific and technical terminology, trademarks, trade names, origin designations of goods and services, and standards introduced in the original language in accordance with standardization regulations.
During the evaluation of submitted offers, the Contracting Authority may request the Contractor to provide explanations regarding the content of the submitted offer and clarifications or supplements to statements and documents.
At the stage of offer consideration and contract signing, the Contracting Authority may require the Bidder to present additional documents confirming the compliance of statements with the factual situation. Details in Request for proposal no. 01/0886/2026/K
