Modernization of the network and purchase of the SOC system to enhance the security of medical documentation at WS-SP ZOZ in Zgorzelec. NR COMPLIANT WITH SWZ: 2.2. The Contracting Authority allows for the submission of equivalent offers. In the case that the Contracting Authority has specified the subject of the order by referencing trademarks, patents, or the origin, source, or specific process characterizing products or services supplied by a particular contractor/manufacturer, if this could lead to favoring or eliminating some Contractors or products - the Contracting Authority permits the submission of equivalent offers. The above-mentioned description of the subject of the order is strictly auxiliary in preparing the offer and aims to indicate the expectations of the Contracting Authority. An equivalent offer is understood to mean an offer with parameters no worse than those specified by the Contracting Authority. The parameters specified by the Contracting Authority are minimum, boundary parameters. By the term “parameters,” we understand functionality, purpose, coloration, structure, materials, size - (only in case of an allowed difference by the Contracting Authority: +/-), safety, durability, form, dose, etc. Consequently, the Contracting Authority allows the possibility of offering the subject of the order with other trademarks, patents, or origin as specified above - however, it does not allow offering an item with different properties and functionalities than those specified in the SWZ. The contractor who adopts equivalent solutions for valuation is obliged to prove the equivalence of the accepted devices, equipment, and materials. To confirm that the offered equivalent solution meets the requirements specified in the SWZ, the contractor shall submit a detailed description of the offered equivalent subject of the order, in which for each product it specifies the manufacturer's name, type/model, and other product features allowing for the unambiguous identification of the offered product and confirmation of compliance with the description of the subject of the order. Failure to submit such a list will be equivalent to accepting the solutions indicated in the documentation. The applied equivalent solutions: No./Description of the subject of the order - requirements of the Contracting Authority/Trade name, catalog number, package size or other designation of the item/Description of the offered equivalent item 2.3. The Contracting Authority does not allow the submission of variant offers (art. 92 of the Act). 2.4. The Contracting Authority does not foresee the conclusion of a framework agreement. 2.5. The Contracting Authority does not foresee granting the order mentioned in art. 214 sec. 1 points 7 and 8 of the Act. 2.6. The Contracting Authority does not foresee an electronic auction. 2.7. The Contracting Authority does not require local inspection or verification of documents necessary for the execution of the order by the contractor, as referred to in art. 131 sec. 2 of the PZP Act. 2.8. The Contracting Authority does not allow for settlements in foreign currencies. 2.9. The Contracting Authority requires the contractor to indicate, in the offer, parts of the order that they intend to subcontract, as well as to provide the names of potential subcontractors if they are already known. 2.10. The Contracting Authority requires that before commencing the execution of the order, the contractor, if already known, provides the names and contact details of subcontractors and persons to contact them involved in the execution of the order. The contractor must notify the Contracting Authority of any changes to the data referred to above during the execution of the order, as well as provide information about new subcontractors to whom they intend to assign the execution of supplies at a later stage. 2.11. If a change or resignation from a subcontractor concerns an entity whose resources the contractor relied on, based on the principles specified in art. 118 sec. 1, in order to demonstrate meeting the participation conditions in the proceedings, the contractor is obliged to prove to the Contracting Authority that the proposed other subcontractor or contractor independently meets them to an extent no less than the subcontractor whose resources the contractor relied on during the proceedings for awarding the order. 2.12. The Contracting Authority does not foresee the possibility of granting advances for the execution of the order. 2.13. The Contracting Authority does not foresee the reimbursement of costs for participation in the proceedings, except for situations referred to in art. 261 of the Act. 2.14. The Contracting Authority reserves, in accordance with art. 139 of the Act, that it will first conduct an examination and assessment of the offers, and then carry out the qualification of the subjective contractor whose offer was rated the highest, in terms of the absence of exclusion grounds and meeting the conditions of participation in the proceedings. 2.15. The Contracting Authority does not allow the submission of offers in the form of electronic catalogs or the attachment of electronic catalogs to the offer in the case specified in art. 93 of the PZP Act. 2.16. In part IV of the Standard Form of the Single European Procurement Document, the Contracting Authority requires filling out part alpha. 3. Description of the subject of the order. 3.1. The subject of the order is: Modernization of the network and purchase of the SOC system to enhance the security of medical documentation at WS-SP ZOZ in Zgorzelec. Task 1: Purchase of the SOC/SIEM system for 36 months Task 2: Implementation of SD-WAN network and modernization of internet connections for 25 locations 3.2. CPV code: Package No. 1 and 2 72700000-7 - Computer network services 3.3. The description of the subject of the order is included in attachments no. 2, 3, 4, and 8.1, 8.2 to the SWZ. 3.4. The Contracting Authority requires that the contractor employ staff under an employment contract within the meaning of the provisions of the Act of June 26, 1974, Labor Code (i.e., Journal of Laws of 2023, item 1465) to perform the indicated below activities related to the execution of the subject of the contract: a) Regarding Package No. 1 - installation, implementation, and monitoring of the network b) Regarding Package No. 2 - implementation and modernization of internet connections C.D.
