Number of days until clarifications can be requested before the deadline for submitting offers / candidacies: 20 days. The contracting authority will respond clearly and fully to all requests for clarification: on the 11th day before the deadline established in the participation announcement for submitting offers.

The completion of the award procedure through the conclusion of the public procurement contract is subject to the following suspensive condition, which will operate for a maximum period of 3 months from the deadline for submitting the offer: The conclusion of the public procurement contract is conditioned upon the maintenance of funding from own revenues/state budget, with the signing of the contract being possible only if the provisions regarding the commitment of expenses from budgetary sources subject to the legislation on public finances are respected, and in accordance with the provisions of Government Decision no. 395/2016 for the approval of the methodological norms for applying the provisions relating to the award of the public procurement contract/framework agreement from Law no. 98/2016 regarding public procurement, with subsequent amendments and completions. In case, regardless of the reasons, the maintenance of funding from own revenues/state budget is not achieved, the contracting authority will apply the provisions of art. 212 para. (1) lit. c) second thesis from Law no. 98/2016, with subsequent amendments and completions, making it impossible to conclude the public procurement contract. Tenderers within this procedure understand that the Contracting Authority and/or MEC cannot be held responsible for any damages in the event of cancellation of the award procedure, regardless of their nature and regardless of whether the Contracting Authority and/or MEC have been notified of the existence of such damage. Tenderers within this procedure accept the use of the special conditions stated above/suspensive clause, assuming full responsibility for any damages they might suffer in the described situation.
