Participation conditions: - Authorization to perform a specific activity or action: 9.1.1. The Tenderer participates in economic turnover, i.e., holds authorizations to perform specific activities or actions covered by the Contract if the laws impose such obligation, and is not subject to liquidation or bankruptcy. The Tenderer shall confirm compliance with this participation condition in the Procedure by submitting a statement in Chapter IA of the SWZ "Offer Form". The Contracting Authority will verify fulfillment of this condition on a "meets/does not meet" basis based on the statement submitted in Chapter IA "Offer Form". In the case of submitting an Offer as a Consortium, the Contracting Authority requires that this condition be met by each Consortium member. - Knowledge and experience: 9.2.1. The Tenderer shall confirm compliance with this participation condition by submitting a statement included in Chapter IA SWZ "Offer Form". The Contracting Authority will verify fulfillment of the exclusion conditions on a "meets/does not meet" basis based on the submitted statement in Chapter IA "Offer Form". In the case of submitting an Offer as a Consortium, the Contracting Authority requires that this condition be met by each Consortium member.
9.2.2. The Tenderer has the necessary knowledge and experience to perform the Contract, particularly in the last 36 months before the deadline for submission of Offers, or if the business operation period is shorter - during that period, the Tenderer has completed for independent, external clients:
9.2.2.1. Delivery and participation in commissioning of at least 6 energy storage systems, each having power of at least 10 MW, made in LFP technology, with a one-, two-, or four-hour system, or delivery and participation in commissioning of at least 1 energy storage system with a power of at least 25 MW, made in LFP technology, with a one-, two-, or four-hour system.
These projects must have been carried out in the territory of the Republic of Poland or in other countries where regulatory, technical, and market conditions regarding delivery and commissioning of energy storage systems are identical or similar to those applicable in Poland. This requirement does not limit experience only to projects made in Poland but allows experience gained in markets where comparable technical standards, safety requirements, and legal frameworks in the field of power engineering and energy storage apply.
The requirement to demonstrate knowledge and experience in delivery and commissioning of energy storage on specified markets as well as defining the reference period in which the experience must be demonstrated is dictated by the need to ensure that the Tenderer has experience gained in market, technological, and regulatory conditions comparable to those prevailing at the place of contract execution. These markets have similar technical standards, level of electric power infrastructure development, safety requirements, and legal frameworks regarding energy storage, allowing a reliable assessment of the Tenderer’s capability to properly execute the Contract. The defined reference period ensures that the Tenderer’s experience is current and reflects latest technological solutions and prevailing industry standards. This limitation is not discriminatory nor does it unjustifiably restrict competition but results from the objective need to ensure appropriate quality and safety of contract execution.
The Tenderer will confirm fulfillment of this participation condition by completing and submitting Attachment T03 "List of completed contracts confirming knowledge and experience", including its contained statement on their correct delivery and participation in commissioning. The Contracting Authority will verify fulfillment of this condition on a "meets/does not meet" basis based on the completed and submitted Attachment T03. In case of submitting an Offer as a Consortium, the Contracting Authority allows fulfillment of this condition jointly as a Consortium. - Persons capable of performing the contract: Contractors may apply who have persons capable of performing the contract meeting the requirements described in points 9.3.1.1 - 9.3.1.2., where regarding professional qualifications, the Contracting Authority considers the Tenderer/Contractor/Supplier meets the requirement also if such person holds appropriate authorizations issued under previously applicable regulations or those issued to citizens of other countries, subject to Article 12a of the Act of 7 July 1994 Construction Law (Journal of Laws 2020.1333 consolidated text with amendments).
