Conditions for participation: - Authorization to perform specified activities or tasks: 9.1.1. The Bidder is engaged in business activities, i.e., holds authorizations to perform activities or tasks covered by the Contract if legal regulations require such authorizations, and is not under liquidation or bankruptcy proceedings. The Bidder shall confirm meeting this participation condition by submitting a statement in Chapter IA TOR "Offer Form". The Contracting Authority will verify compliance with this condition on a "meets/does not meet" basis based on the submitted statement in Chapter IA TOR "Offer Form". In the case of submitting an Offer as a Consortium, the Contracting Authority requires each Consortium member to meet this condition. - Knowledge and experience: 9.2.1. The Contracting Authority will verify the fulfillment of the exclusion grounds condition on a "meets/does not meet" basis based on the submitted statement in Chapter IA TOR "Offer Form". For Consortium Offers, this condition must be met by each member.
9.2.2. The Bidder has the necessary knowledge and experience to perform the Contract, in particular within the last 36 months before the Offer submission deadline, or if the activity period is shorter – within that period, the Bidder has realized for independent, external clients:
9.2.2.1. Delivery and participation in commissioning at least 6 energy storage units, each with a power of at least 10 MW, made with LFP technology, in a one-, two- or four-hour system, or delivery and participation in commissioning at least 1 energy storage unit with a power of at least 25 MW, made with LFP technology, in a one-, two- or four-hour system.
These projects must have been carried out in the territory of the Republic of Poland or in other countries where regulatory, technical, and market conditions for delivery and participation in energy storage commissioning are identical or similar to those in Poland. This requirement does not limit experience exclusively to projects completed in Poland but allows experience gained on markets with comparable technical standards, safety requirements, and legal frameworks in the energy and energy storage sectors.
The requirement to demonstrate knowledge and experience in deliveries and participation in commissioning energy storage on specific markets and the reference period in which the experience must have been demonstrated is dictated by the need to ensure the Bidder has experience gained under market, technological, and regulatory conditions comparable to those prevailing at the place of Contract execution. The indicated markets have similar technical standards, infrastructure development levels, safety requirements, and legal frameworks concerning the energy sector and energy storage, enabling reliable assessment of the Bidder’s ability to properly execute the Contract. The defined reference period ensures the Bidder’s experience is current and reflects the latest technological solutions and industry standards. This limitation is not discriminatory and does not unjustifiably restrict competition but results from the objective need to ensure the adequate quality and safety of Contract performance.
The Bidder shall confirm compliance with this participation condition by completing and submitting Annex T03 "List of completed orders confirming knowledge and experience," including the declaration of their correct delivery and participation in commissioning.
The Contracting Authority will verify compliance with this condition on a "meets/does not meet" basis based on the completed and submitted Annex T03. The Bidder shall confirm fulfillment of this condition by presenting a list of specialists and areas of expertise who will be available to the Contracting Authority during the Contract implementation period for BESS supply.
The list includes at least the following roles: 9.3.1.1. Client Supervisor / Project Manager – person appointed by the Contractor/Supplier as the main contact point responsible for ongoing communication with the Contracting Authority and coordination of information flow / person responsible for coordination of deliveries and documentation to ensure timely and contract-compliant delivery of BESS systems.

Before starting work on the Project, the person must have valid SEP licenses for operation and supervision of devices, installations, and networks up to 1 kV and above 1 kV.
The job titles may vary in the company structure, but the scope of roles should be identical. Due to detailed deadlines for Contract execution, the Bidder will indicate a substitute person for each member of staff in case of absence. The Contracting Authority requires each person indicated under points 9.3.1.1 and 9.3.1.2 to be fully available to the Contracting Authority within the Project for an average of 40 hours per week from delivery until successful commissioning and testing of the installation. The conversion is made to verify compliance with the participation condition regarding the required minimum guarantee sum of civil liability insurance. The Tenderer is obliged to indicate in the Tender the value of the insurance sum in the original currency of the policy and to attach a copy of the policy confirming these data.
