Description:
The project focuses on developing green and blue infrastructure around the hospital to enhance climate change adaptation, including landscaping, lighting, and the creation of recreational green spaces for patients and residents.

1. The subject of this order is a service aimed at adapting to climate change through the development of green and blue infrastructure surrounding the hospital. The subject of the order includes comprehensive development of the area, including surface replacement, earthworks, renovation of the firewater tank, installation of small architecture, replacement of lighting poles, and the creation and maintenance of greenery through flowerbeds, lawns, flower meadows, and rain gardens. The intended purpose of the area is to make it available to residents and primarily to patients of the nearby hospital for relaxation and recreation among the newly planted greenery.
2. A Detailed Description of the Subject of the Order can be found in the project documentation consisting of:
a) land development project with attachments,
b) technical project,
c) greenery development project,
d) cost estimate (for reference only),
e) information on safety and health protection,
f) technical specifications for execution and acceptance of works,
which constitute Annex No. 1 to the Terms of Reference (SWZ), as well as in the proposed provisions of the contract, which are Annex No. 2 to the SWZ.
3. The order has been co-financed under the Project: European Funds for Pomerania 2021-2027, Priority 2. European Funds for Green Pomerania, Action 2.11 Adaptation to Climate Change - ZIT outside the metropolitan area, co-financed by the European Regional Development Fund.
4. If any doubts or ambiguities arise for the Contractor regarding the aforementioned elements of the order description, then for the final determination of the Client's requirements in this matter and the preparation of the offer by the Contractor - the clarifications, specifications, and supplementary information obtained during the formal procedure of any inquiries to the SWZ will be binding.
5. If anywhere in the SWZ the subject of the order is defined by indicating trademarks, proper names, brand names, or origins, the Client allows in this respect the submission of offers using equivalent solutions described. Wherever the description of the subject of the order indicates the origin of the devices covered by the order, mentioned in Article 99(5) of the Public Procurement Law, the Client allows the offering of devices with equivalent parameters - identical or higher than those contained in the description. The term equivalency means that they will guarantee the realization of the order in accordance with the description of the subject of the order and ensure the achievement of technical and quality parameters and warranty requirements no worse than those specified in the above description. The proper names provided in the descriptions of the subject of the order serve only to specify the quality, technical, and technological expectations of the Client.
6. According to Article 101(4) of the Public Procurement Law, in the event that the Description of the Subject of the Order contains references to standards, European technical assessments, approvals, technical specifications, and technical reference systems referred to in Article 101(1)(2) and (3) of the Public Procurement Law, and such references are not accompanied by the expression “or equivalent,” it should be assumed that each: standard, European technical assessment, approval, technical specification, technical reference system present in the Description of the Subject of the Order is accompanied by the words “or equivalent.”
7. A Contractor who refers to equivalent solutions is required to demonstrate that the solutions offered meet the requirements specified by the Client. In such a case, the Contractor attaches to the offer a list of equivalent solutions along with its description or standards.
8. The order is not divided into parts: the justification for the lack of division of the order into parts is contained in Section III(5) of the SWZ.
9. Persons participating in the opening of tenders: members of the tender committee appointed by the Decision of the Starost of Sztum County.


LOT-0001
Adaptation to Climate Change through the Development of Green and Blue Infrastructure Surrounding the Hospital.
1. The Client informs that:
a) The Client does not foresee an electronic auction.
b) The Client does not foresee the submission of an offer in the form of electronic catalogs.
c) The Client does not conduct proceedings to conclude a framework agreement.
d) The Client does not allow for the possibility of submitting variant offers.
e) The Client does not foresee the reimbursement of participation costs in the proceedings, including the reimbursement of costs incurred for obtaining a qualified electronic signature.
f) The Client does not foresee advances for the performance of the order.
g) The Client does not reserve the possibility of applying for the award of the contract exclusively by Contractors referred to in Article 94 of the Public Procurement Law.
h) does not reserve the obligation for the Contractor to personally perform key tasks,
i) The Client does not specify additional requirements related to employing persons referred to in Article 96(2)(2) of the Public Procurement Law.
j) The Client does not foresee the awarding of contracts referred to in Article 214(1)(7) of the Public Procurement Law.
k) The Client does not foresee checking by the Contractor documents necessary for the performance of the order, referred to in Article 131(2) of the Public Procurement Law.
l) The Client will not use the reverse procedure regulated in Article 139(1) of the Public Procurement Law.
m) does not foresee settlements in foreign currencies,
n) a site visit is not planned,
2. The Client informs that the requirements regarding subcontracting, employment under an employment contract under Article 95(1) of the Public Procurement Law, joint bidding for public procurement, reliance on the resources of a party providing resources are contained in the provisions of the SWZ, as well as partially in the proposed provisions of the contract.
3. Subjective evidence:
1. The Contractor applying for the award of public procurement attaches to the offer current as of the date of submission:
1) a declaration referred to in Article 125(1) of the Public Procurement Law (JEDZ) - in the scope indicated by the Client - the specimen of the declaration is Annex No. 4 to the SWZ.
NOTE: regarding the exclusion premise in relation to Article 7(1)(1) - (3) of the Act of April 13, 2022, on special solutions concerning the counteraction of the support for aggression against Ukraine and serving the protection of national security, the Contractor submits a declaration in Part III Section D JEDZ “Exclusion Grounds of a Solely National Nature”,
2) a declaration regarding Article 5k of Regulation 2022/576 amending Regulation (EU) No. 833/2014 concerning restrictive measures in connection with actions by Russia destabilizing the situation in Ukraine dated April 8, 2022 - the specimen of the declaration is Annex No. 5 to the SWZ.
2. In the case of joint bidding by Contractors (including partners of a civil partnership), the declarations referred to in paragraph 1(1) and (2) are submitted by each of the Contractors jointly applying for the order.
3. The Contractor, in the case of relying on the capacities of entities providing resources, presents:
1) together with the declaration referred to in paragraph 1(1), also a declaration (JEDZ) of the entity providing resources, confirming the absence of grounds for excluding this entity and appropriately meeting the conditions for participation in the procedure, to the extent that the Contractor refers to its resources,
2) a declaration of the entity providing resources regarding the absence of grounds for exclusion under Article 5k of Regulation 2022/576 amending Regulation (EU) No. 833/2014 concerning restrictive measures in connection with actions by Russia destabilizing the situation in Ukraine dated April 8, 2022 - the specimen of the declaration is Annex No. 6 to the SWZ.
4. In the case of Contractors jointly applying for the award of the order in accordance with Article 117(4) of the Public Procurement Law, they attach to the offer a declaration indicating which services will be performed by each Contractor - the specimen of the declaration is Annex No. 7 to the SWZ.
5. According to Article 126(1) of the Public Procurement Law, the Client, before choosing the most advantageous offer, will call on the Contractor whose offer is rated the highest to submit within the specified time, not shorter than 10 days from the day of the call, subjective evidence, current on the day of submission, i.e.:
1) information from the National Criminal Register in the scope specified in Article 108(1)(1), (2), and (4) of the Public Procurement Law prepared not earlier than 6 months before its submission,
2) a declaration of the Contractor regarding Article 108(1)(5) of the Public Procurement Law on the absence of affiliation with the same capital group within the meaning of the Act of February 16, 2007, on competition and consumer protection, with another Contractor who submitted a separate offer, or a declaration of affiliation with the same capital group along with documents or information confirming the preparation of the offer independently of another Contractor belonging to the same capital group - the specimen of the declaration is Annex No. 9 to the SWZ,
3) a declaration of the Contractor on the current state of information contained in:
a) the JEDZ declaration submitted on the basis of Article 125(1) of the Public Procurement Law, in respect of grounds for exclusion indicated by the Client, referred to in Article 108(1)(3) - (6) of the Public Procurement Law and Article 7(1)(1) - (3) of the Act of April 13, 2022, on special solutions for counteracting support for aggression against Ukraine and serving the protection of national security,
b) the declaration confirming the absence of grounds for exclusion under Article 5k of Regulation 2022/576 concerning the amendment of Regulation (EU) No. 833/2014 regarding restrictive measures in connection with Russia’s actions destabilizing the situation in Ukraine dated April 8, 2022 - the specimen of the declaration is Annex No. 10 to the SWZ.
4) a list of services performed along with attaching evidence determining due execution - the specimen of the list of services is Annex No. 11 to the SWZ.
5) a list of persons - the specimen list is Annex No. 12 to the SWZ.
