Meeting the procurement need identified by the contracting authority will involve awarding a public procurement contract (Contract Agreement accompanied by General and Specific Conditions) in which the object includes technical design services, technical verification, technical assistance, and execution of modernization and development works for the infrastructure of Zimnicea Port. The contractor selected as a result of this procedure will be obligated to carry out multiple activities that will be concretized by:
Preparing the Technical Execution Project in compliance with Annex no. 10 to HG 907/2016 regarding the stages of elaboration and the framework content of the technical-economic documentation related to the objectives/projects of investment funded from public funds, including detailed field studies if necessary and execution details),
Performing the technical verification of the project in accordance with the provisions of Decision no. 925/1995 for the approval of the Regulation regarding the verification and technical expertise of projects, the technical expertise of the execution of works and constructions, as well as the verification of the quality of works, with subsequent amendments and completions,
Providing the necessary technical assistance during the execution period of the works (including the determining phases and any modifications to the project carried out, respecting relevant legislation, including that applicable in the field of public procurement)
Preparing the report upon completion of permanent works execution,
Preparing the “As Built” Project for the rehabilitation and modernization works of the port infrastructure in Zimnicea Port.
The main works to be executed concern the following:
The upstream sector of the port (sector 1),
The berths where the docking occurs through floating pontoons, in the upstream area of the docking front (sector 2),
The existing vertical operation front (sector 3), for the rehabilitation of berths 3 - 6,
Rehabilitation of existing roads and platforms in the port,
Dredging, provisional and definitive signaling,
Utilities: Water and sewerage networks and installations, including electricity supply.
Detailed information regarding the services and works subject to this procurement can be found in the specifications, including the Beneficiary's Requirements and its annexes (the technical-economic documentation prepared at the design phase SF with elements of DALI).
The number of days until which clarifications can be requested before the deadline for submitting offers is 18 days. To the extent that requests for clarifications or additional information are addressed within the timeframe set by this data sheet, namely 18 days, the contracting authority will respond clearly and completely to all requests for clarification/additional information 11 days before the deadline set for submitting offers, according to art. 161 of Law no. 98/2016.

The contracting authority is conducting this open auction for the awarding of the Contract Agreement for technical design services, technical verification including technical assistance and execution of works provided by the project “Rehabilitation, modernization, equipping Zimnicea Port”, code SMIS 343266, which will be conducted in compliance with the General and Specific Conditions for design and execution contracts, according to Annex no. 2 to HG no. 1/2018, especially regarding the duration, quantity, and cost of the services and works, thus ensuring a proper use of the available funds, as well as compliance with standards and technical quality requirements. Given the specific contractual framework, the Contract Agreement will be managed, according to the provisions of HG no. 1/2018, through the Supervisor. For this purpose, the contracting authority initiated the procedure for awarding the supervision services contract through the simplified participation announcement no. SCN1172250/06.02.2026. The execution of this public procurement contract will be based mainly on the Contract Agreement concluded with the Contractor, the general and specific conditions prepared in compliance with Annex no. 2 to HG no. 1/2018. The object of the contract will include the following: • Technical design services, technical verification, and technical assistance provided by the Specialized Designers of the Contractor. • Execution of rehabilitation, modernization, and equipping works for Zimnicea Port. Specifically, the execution of the works included in the object of this Contract Agreement will consist of: • Arranging the upstream berth as a waiting berth for pushers, • Rehabilitation of berths 1 and 2, • Rehabilitation of operational berths 3-6, • Implementing a potable water supply system, • Rehabilitation of existing roads and platforms in the port, • Establishing provisional and definitive signaling installations, • Providing utilities within the port and at the docks, namely water supply, • Providing utilities within the port and at the docks – facilities for fire extinguishing, • Implementing a lighting system for the port area, • Providing utilities within the port and at the docks, namely electricity supply, • Providing utilities within the port and at the docks, namely sewage system, • Dredging, provisional and definitive signaling. The estimated total value of the procurement is 48,752,900.00 lei, without VAT, of which: • Technical design services - 986,000 lei, • Technical verification services - 98,000 lei, • Services for preparing documentation for obtaining approvals - 50,000 lei, • Technical assistance services - 120,000 lei, • Health and Safety Coordinator - 40,000 lei, • Execution of works - 47,458,900 lei. Although they were not included in the estimated value of the procurement, amounts found on Lines 5.3 and within Chapter 7 of the General Estimation for this investment objective, which was prepared in compliance with the provisions of HG no. 907/2016 regarding the stages of elaboration and the framework content of technical-economic documentation related to objectives/investment projects funded from public funds, with subsequent amendments and completions, will also be taken into account when establishing the applicable award procedure. Thus, if during the implementation of the Contract Agreement there occurs a need for changes that also involve the increase of its value, they can only be made in accordance with the provisions of art. 221 and subsequent articles of Law no. 98/2016, provisions that will be correspondingly correlated with the provisions of ANAP Instruction no. 1/2021. The amounts accounted for within Chapter 7 of the General Estimation for the investment objective have been considered for determining the award procedure and can be categorized into two categories, namely: 1. The budget margin represents the amount found on Line 7.1. Expenses related to the budget margin, valued at 12,188,225 lei, without VAT, namely 25% of the estimated value of this procurement. During the implementation of the public procurement contract, this amount may be used in compliance with the provisions of the legislation in the field of public procurement, taking into account the calculation methodology used for the budget margin of 25%, which will be applied to the amounts indicated on the corresponding lines of the estimation, as they will be reflected in the offer of the economic operator declared the winner, lines to which the contracting authority referred for establishing the estimated value. At the same time, when using the amounts related to the budget margin for implementing potential contractual changes, the provisions of art. 10 para. (21) of HG no. 907/2016 will also be considered. 2. The implementation reserve represents that amount found on Line 7.2. of the General Estimation, prepared at the SF design phase, which will be used in accordance with the provisions of art. 2222 para. (9) of Law no. 98/2016. In order to establish the applicable award procedure, the estimated amount detailed above will also include the amount included in Line 7.2. Expenses for establishing the implementation reserve for price adjustment, namely 7,148,100 lei without VAT. Subsequently, during the execution of the public procurement contract, price adjustments will be determined specifically by reference to the work situations prior to payment by the Contractor, which will be verified by the Supervisor and validated by issuing payment certificates. Various and unforeseen expenses represent the amount inscribed on the Estimation Line 5.3. valued at 4,735,390 lei, without VAT and which has been taken into account for establishing the applicable award procedure, being used in compliance with the requirements of the legislation in the field of public procurement.
