The project includes the comprehensive construction, reconstruction, and demolition of structures on the premises of the wastewater treatment plant in Bukowno, as part of which the modernization of the facility will be carried out. The investment scope has been tailored to meet current needs related to identified technical and technological deficiencies of the existing wastewater treatment plant, the description of the subject matter of the order, and formal and legal requirements. The planned new and existing facilities after expansion will constitute the designed land development of the wastewater treatment plant.

- The Contractor is also obliged to take into account the requirements related to cybersecurity in accordance with the updated legal status. These requirements are detailed in Appendix No. 4 to the OPZ - Technical Requirements for Supplies regarding cybersecurity (WTDC).
- Existing conditions and specific circumstances:
The Water and Sewage Company Sp. z o. o. on January 5, 2024, obtained a building permit, decision No. 3/2024, valid from January 25, 2024. On this basis, on October 24, 2024, the Company began the first tender procedure for selecting the Contractor for the construction works related to the modernization of the wastewater treatment plant in Bukowno. At the same time, a significant increase in the inflow of wastewater to the treatment plant was recorded due to the infiltration of groundwater into the sewerage system.
After locating the leak in the sewer collector, which brings wastewater to the Wastewater Treatment Plant in Bukowno, the Company started repair work. However, the above situation is caused by the rising groundwater levels related to the flooding of inactive zinc and lead ore mines. Simultaneously, after conducting a site inspection, new wetland areas were found, particularly near Nowa Street and Puza Street in Bukowno, located a short distance from the Wastewater Treatment Plant in Bukowno.
During the tender procedure, considering the new circumstances, the Company commissioned geological studies to verify the ground-water conditions relative to the design assumptions. After carrying out new drillings, it turned out that the ground-water conditions compared to studies conducted in April 2023 had drastically deteriorated.
As a consequence of the changing ground-water conditions within the area adjacent to the treatment plant, as well as at the plant itself and the need to conduct additional hydrogeological studies, the Company on December 18, 2024, cancelled the tender for construction works related to the modernization of the wastewater treatment plant.
- The subject of the currently processed application for a change in the building permit is the design of changes concerning the original building project, building permit decision No. 3/2024 dated January 5, 2024 [SAB.6740.3.74.2023]. The changes include: changes in the external dimensions of the coarse screen chamber (ob.02) and the channel between ob.02 and the multifunctional facility (ob.03), weightening of the block chambers of the biological reactors with a blower station (ob.06), increasing the external dimensions of secondary settlers and the wastewater distribution chamber and sludge collection chambers ob.08a, 08b, 07a, and 07b, as well as increasing the external dimensions of the tank for delivered wastewater (ob.11).
- A complete and detailed description of the legal and factual status is included in the OPZ - Appendix No. 1. Also significant are the contractual provisions in this regard - particularly in § 2 of the Proposed Contractual Provisions (Appendix No. 2 to the SWZ).
- Consequently, the Contracting Authority is conducting administrative proceedings concerning the change of the building permit decision issued for the investment covered by this procedure. If, during the execution of the Agreement, the Contracting Authority obtains a final decision to change the building permit, the Contractor undertakes to execute the works based on the amended building permit decision, after the relevant documentation is provided to them by the Contracting Authority. The Contracting Authority expects that by the time the contract with the Contractor is concluded, they will obtain a decision to change the building permit.
- The updated documentation mentioned above forms an integral part of this SWZ and is listed in point 4 of the OPZ - Appendix No. 1 to the SWZ.
- The Contractor should price the bid based on the alternative design described in point 3.2 OPZ (Appendix No. 1 to the SWZ).
- In the event of an extension of the administrative procedure concerning the change of the building permit over 45 days from the date of signing the Agreement, the Contractor is entitled solely to a claim for an extension of the deadline for the performance of the contract for the duration of the obstacle. The Contractor waives claims for lost profits and standby costs, provided that the Contracting Authority notifies of the delay with at least 7 days' notice.
- All works must be carried out based on industry project designs for individual facilities and supplementary studies included within the scope of project documentation for the undertaking. The required warranty period for the entire subject of the order is 60 months, except for devices, for which the warranty period cannot be shorter than 24 months from the date of signing the final acceptance protocol.
