Description:
Delivery of a brand new MEGA electric bus with a mobile charger for public transport in Suwałki, including compliance with new technical standards, installation, and training.

1. The subject of the contract is the delivery of one brand new MEGA electric bus along with a mobile charger for public transport in Suwałki.
2. A detailed description of the subject of the order is included in Annex No. 2 to the SWZ.
3. If during the execution of the contract, after signing the agreement, new legal regulations introducing new technical requirements and mandatory standards are announced, the Contractor shall implement them in the vehicles before handing over the buses to the Ordering Party.
4. The scope of the order includes, among others, all public law burdens, costs of technical inspections, receptions, fulfillment of obligations resulting from the granted warranty, costs of documentation, software, licenses, transport, unloading at the delivery location, insurance against the risk of loss or damage to the subject of the order until acceptance by the Ordering Party, installation of the charging station, periodic inspections, preparation of all documentation including that necessary for carrying out inspections by UDT, access to the service platform, training of personnel.
5. In accordance with Article 101 paragraph 4 of the Act, where the subject of the order is described using standards, technical assessments, technical specifications, and systems of technical references, the Ordering Party allows equivalent solutions to those described. Furthermore, it should be assumed that all such references are accompanied by the words “or equivalent.” Indicating the equivalence of the offered solution, in accordance with Article 101 paragraph 5 of the Act and under the terms specified therein, rests with the Contractor; in such case, the Contractor is obliged to prove, by attaching to the offer the relevant subject-specific evidence mentioned in Articles 104-107 of the Pzp Act, that the proposed solutions meet the requirements specified in the description of the subject of the order to an equivalent degree.
6. In the event that trademarks were used in the SOPZ documentation (detailed description of the subject of the order), it means that they are given by way of example and define only the minimum expected quality parameters and required standards. The Contractor may use equivalent materials or devices, but with similar or better technical and quality parameters, the application of which in no way affects the proper functioning of solutions adopted in the SOPZ documentation. The Contractor who uses equivalent devices or materials will be obliged to demonstrate during the execution of the order that the materials and devices used by him meet the requirements set by the Ordering Party.
7. The use of labels in the SOPZ documentation means that the Ordering Party accepts all labels confirming that the given deliveries or services meet the equivalent requirements set by the Ordering Party's label. If the Contractor cannot obtain the label specified by the Ordering Party or an equivalent label for reasons beyond his control, the Ordering Party will, within a deadline set by himself, accept other relevant subject-specific evidence, particularly the manufacturer's documentation, provided that the Contractor proves that the deliveries or services to be performed by him meet the requirements of the specified label or specific requirements indicated by the Ordering Party.
8. The use in the documentation of the requirement to possess a certificate issued by a conformity assessment body or reports from tests conducted by that body as evidence confirming compliance with the requirements or characteristics specified in the description of the subject of the order, assessment criteria for offers, or conditions for the execution of the order means that the Ordering Party also accepts certificates issued by other equivalent conformity assessment bodies. The Ordering Party also accepts other appropriate evidentiary measures, particularly technical documentation from the manufacturer, if the Contractor does not have access to certificates or reports from tests, or the ability to obtain them in a timely manner, provided that this lack of access cannot be attributed to the Contractor, and on the condition that the Contractor proves that the deliveries or services he is performing meet the requirements or criteria specified in the description of the subject of the order, the assessment criteria for offers, or requirements related to the execution of the order.
9. In the case of description using standards, equivalent solutions are considered to be those that ensure the meeting of minimum requirements specified in the standard at a level not worse than described in the relevant standards. In the case of the standards referred to in the SWZ (if not specified in detail), current standards are understood. In other cases (description of the subject of the order using technical assessments, technical specifications, and systems of technical references), a product, material, or system with technical, functional, and quality parameters not worse than those mentioned in the description of the subject of the order is considered equivalent.
10. As part of the informational and promotional activities of the project, the Contractor is required to place stickers inside and outside the bus in accordance with the Applicant's and Beneficiary's Handbook of European Funds for 2021-2027 regarding information and promotion.
11. The project titled “Sustainable Urban Mobility in the Functional Urban Area of Suwałki” is co-financed under the program European Funds for Eastern Poland 2021-2027, Priority FEPW.03 Sustainable Urban Mobility, Action FEWP.03.01 Sustainable Urban Mobility.
12. The Ordering Party informs that in accordance with Article 257 of the Pzp Act, he may cancel the procurement procedure if the public funds that the Ordering Party intended to allocate to finance all or part of the order have not been granted to him.
