The purpose of the procurement is the design and execution of the works related to the investment objective "Rehabilitation and electrification of the railway line cf 816 Palas - Port A, consolidation of tunnel km 224+670-225+160 to ensure a second railway access to the Port of Constanța", in accordance with the provisions of the Specifications no. 8/1/1912/03.09.2025 and the attached technical documentation.
The procurement aims to design and execute the works for the realization of the railway line on the existing route in a single line configuration, including the rehabilitation and extension of the tunnel by 200 m towards the Palas station, the installation of a new BLAI facility and the related network of cables, modification of the existing electronic centralization equipment in Palas station, as well as the electrification of the current line Palas – Constanța Port Zone A.
The proposed works, which need to be executed, are detailed in the D.A.L.I. document, with execution scenario III A, approved by the CTE CNCF “CFR”, which will be made available to the Contractor by the Contracting Entity.
SUSPENSIVE CLAUSES:
The award procedure is carried out under the incidence of these suspensive clauses, in the sense that:
a) the conclusion of the sectoral contract with the economic operator who will be declared the winner following the completion of the sectoral procurement procedure for the realization of the investment objective "Rehabilitation and electrification of the railway line cf 816 Palas-Port A, consolidation of tunnel km 224+670-225+160 to ensure a second railway access to the Port of Constanța (design and execution)" is conditioned by obtaining/approval of the funding for the works, the signing of the contract being possible only in the event that the provisions regarding the engagement of expenses from the budgets covered by public finance legislation are respected. Taking into account the provisions of Law no. 99/2016 and HG no. 394/2016, the Contracting Entity specifies that it will conclude the sectoral procurement contract with the offered declared winner only to the extent that the necessary funds for the procurement will be secured from the state budget and/or other legally constituted funds, within a maximum of 12 months from the approval of the Procedure Report. We specify that the Contracting Entity makes all necessary administrative efforts to obtain financing.
In the event that, although the necessary legal steps will be initiated, obtaining/approval of the financing for the works from state budget funds and/or other legally constituted funds does not take place, after receiving notification from the competent authorities regarding the non-provision of financing, the Contracting Entity will have the obligation to annul the procurement procedure, without creating the artificial circumstances for annulment of the procedure, being impossible to conclude the public procurement contract, in this regard becoming applicable the provisions of art. 225 para (1) lit. c) second thesis of Law 99/2016 "The contracting entity is obliged to annul the award procedure for the sectoral contract/framework agreement (...) if breaches of legal provisions affect the award procedure or if it is impossible to conclude the contract".
The Contracting Entity estimates it may obtain the necessary financing for signing the contract within 12 months from the approval of the Procedure Report.
In light of this aspect, bidders will consider extending the validity of the offer and the participation guarantee, at the request of the Contracting Entity, until the signing of the contract.
b) after the procurement is completed (approval of the procedure report, finalization of complaints, etc.), the signing of the design and execution contract will be conditioned by obtaining the approval of the Board of Directors of CNCF "CFR" SA.
Number of days until which economic operators can request clarifications before the deadline for submitting offers: 22 days

In the year 2023, the service for elaborating technical expertise and approval documentation (DALI) was contracted to establish the correct diagnosis and necessary works for reopening the double railway line, electrification, centralization, consolidation of the railway land, to ensure the circulation of railway convoys for the investment objective "Rehabilitation and electrification of the railway line cf 816 Palas-Port A, consolidation of tunnel km 224+670-225+160 to ensure a second railway access to the Port of Constanța" – technical expertise and DALI. Through this investment, it is aimed to ensure the second railway access from Palas station to the Port of Constanța.
The project will be developed and implemented according to Scenario IIIA – rehabilitation of the existing railway tunnel for electrified single track, extending 200 m towards Palas station. All rehabilitation and extension works will be undertaken according to the applicable Technical Interoperability Specifications (STI) to ensure technical compatibility, safety and necessary performance for efficient operation. This is essential to fully support loading handling activities in the port and to facilitate optimal integration into the European railway network.

Through the implementation of the project, the railway line will be modernized according to the technical parameters required by the current European standards and legislation, and the activity in Constanța Port will be optimized, thus increasing interoperability.
The investment project aims to ensure the conditions for creating an efficient, sustainable, flexible, and safe transport system, an essential concern for Romania's economic development.
To achieve the investment objective "Rehabilitation and electrification of the railway line cf 816 Palas - Port A, consolidation of tunnel km 224+670-225+160 to ensure a second railway access to the Port of Constanța (design and execution)" the following are necessary:
A. Design Services
The technical project for each structure will be elaborated in accordance with the legal regulations in force, namely the Government Decision no. 907/29.11.2016, regarding the stages of elaboration and the framework content of technical-economic documentation related to investment objectives/projects financed from public funds, with subsequent amendments.
The technical-economic documentation may only be carried out by specialized designers holding the appropriate railway technical approvals issued by AFER, certified for ISO 9001 quality system, issued by accredited bodies, and possessing adequate technical means for design and verification.
B. Execution Works
The works will be executed in accordance with the approved technical documentation, in the order of technological execution, with strict compliance with the quality control program for the works and the decisive phases. The actual execution of the proposed works will begin on the basis of the Work Start Order, transmitted to the contractor by SRCF Constanța, only after obtaining the favorable opinion from the Technical - Economic Council of CNCF “CFR”- SA for the technical project and obtaining the construction authorization (AC).
The proposed works and those to be executed are detailed in the D.A.L.I. document, with scenario III A of execution, approved by CTE CNCF “CFR”, which will be made available to the Contractor by the Contracting Entity.
Technical Expertise, DALI and Environmental Agreement will be published by the Contracting Entity within the awarding documentation and will form the basis for estimating the categories of expenses within the contract.

Contract Duration
The estimated duration of the implementation of the contract is 32 calendar months, of which:
• Elaboration of PTH, DDE, DTAC and Issue of Construction Authorization (AC) - 6 calendar months from the administrative start order, of which:
- Preparation of Technical Documentation for obtaining Building Permit (DTAC) - 2 months;
- Preparation of Technical Execution Project (PTE) and Execution Details (DDE) - 4 months;
- Issuance of Construction Authorization (AC) - 1 month (within the design period).
• Approval of documentation prepared by the Contractor - 2 months;
• Execution of works - 24 calendar months from the issuance of AC and the start order.
The warranty period (Defect Notification Period) is 60 calendar months from the Acceptance at the Completion of Works.
