Supply of 24 UAS, S-UAS detection and combat systems, intended to increase the security measures of military objectives, as follows:
1. LOT 1 - UAS detection system, S-UAS = 2 complete
2. LOT 2 - Portable UAS combat system, S-UAS = 22 complete

Interested economic operators will be able to request clarifications up to 14 days before the deadline for submitting bids. The procedure for awarding the public procurement contract is initiated under this suspensive clause, in the sense that the award of public procurement contracts is conditional on the allocation of budget appropriations for this purpose, the signing of the contracts being made in compliance with the provisions regarding the commitment of expenditures from the budgets falling under the public finance legislation. Taking into account the provisions of Law no. 98/2016 on public procurement and G.D. no. 395/2016, as subsequently amended and supplemented, the contracting authority specifies that it will conclude contracts with the bidders declared winners only to the extent that the funds necessary for the acquisition will be ensured by allocating budget appropriations for this purpose. If, for any reason, the budget appropriations will not be allocated, the contracting authority, after receiving the notification regarding the non-granting of funding, reserves the right to cancel the award procedure under the conditions in which there is no other source of financing, in accordance with the provisions of art. 212, para. (1), letter c) sentence 2 of Law 98/2016 with subsequent amendments and completions, being impossible to award the public procurement contract. The tenderers in this procedure understand that the contracting authority cannot be held liable for any damage in the event of the annulment of the award procedure, regardless of its nature and regardless of whether the contracting authority has been notified of such damage. The bidders in this procedure accept the use of the above conditions/suspensive clause, assuming full responsibility in relation to any damages they may suffer in the situation described.
