Description:
Delivery of components for a Battery Energy Storage System with a total intended capacity of 840 MWh, including a guaranteed order of at least 600 MWh within 24 months, while allowing for potential advances and option rights.

The subject of the procurement includes the delivery (without installation and commissioning) of components for the Battery Energy Storage System (BESS) with usable power and capacity according to Annex 1a to the OPZ ("List of BESS Projects"). The contractor will deliver complete, brand new devices prepared for efficient installation and commissioning by the Ordering Party or a separate Contractor, and will participate in the commissioning of the delivered BESS system – in accordance with the OPZ. The contract will be in effect for a period of 36 months from its conclusion.
The detailed Description of the Subject of the Procurement consists of the following documents:
1) Description of the Subject of the Procurement ("OPZ")
2) List of BESS Projects, which is Annex 1a to the OPZ
1. The Ordering Party plans to execute deliveries of BESS systems with a total intended capacity of 840 MWh, in various power/capacity configurations, in accordance with Annex 1a to the OPZ.
2. The Ordering Party guarantees to place orders and purchase a total of at least 600 MWh of usable capacity within 24 months from the conclusion of the contract in configurations resulting from the needs of the Ordering Party and from Annex 1a to the OPZ.
3. The Ordering Party anticipates the possibility of exercising the option right under Article 441 of the Public Procurement Law (uPZP), increasing the scope of the order by 240 MWh to the planned level of 840 MWh. The detailed method of exercising the option right is described in the procurement documentation.
4. The Ordering Party allows the possibility of providing the Contractor with advances for the execution of the subject of the order, in accordance with Article 442, paragraph 1 of the uPZP. The total value of advances will not exceed 100% of the gross contractual remuneration. The detailed method of granting advances is described in the procurement documentation.

The exercise of the option right does not apply to the contract concluded between Enea Ciepło sp. z o.o. as the Ordering Party and the selected Contractor. The Ordering Party allows the possibility of providing the Contractor with advances for the execution of the subject of the order, in accordance with Article 442, paragraph 1 of the uPZP. The total value of advances will not exceed 100% of the gross contractual remuneration. The detailed method of granting advances is described in the procurement documentation.
