The procedure for awarding the public procurement contract is initiated under the incidence of this suspensive clause, in the sense that the conclusion of the public procurement contract is conditioned by the allocation of budget credits for this purpose, the signing of the contract being done in accordance with the provisions regarding the commitment of expenses from budgets subject to the public finance legislation.
Considering the provisions of Law 98/2016 regarding public procurement and H.G. no. 395/2016 with subsequent modifications and completions, the Contracting Authority specifies that it will conclude the contract with the declared winning bidder only to the extent that the necessary funds for the purchase are ensured through the allocation of budgetary credits for this purpose. In case the budget credits are not allocated, regardless of the reasons, the Contracting Authority, after receiving notification regarding the refusal of financing, reserves the right to cancel the awarding procedure, in the conditions where there is no other source of financing, in accordance with the provisions of art. 212 para. (1) letter c) second thesis of Law 98/2016 with subsequent modifications and completions, making it impossible to conclude the public procurement contract.
The number of days until which clarifications can be requested before the deadline for submitting offers: 17 days
NOTE: According to art. 161 of Law no. 98/2016 with subsequent modifications and completions, as long as clarifications are requested in due time, the response of the contracting authority to these requests will be published in SEAP on the 11th day before the established deadline for submitting offers (see deadlines in the announcement of participation published in SEAP).
